TERMS & CONDITIONS

1. PREVIEW:
Previews are available by appointment for inventory located at our warehouse facility; 325 West Potter Rd. Anchorage, AK 99518. Additional photographs, videos, or condition reports available upon request, please forward requests to Admin@AlaskaPremierAuctions.com at least 48 hours prior to auction closing.

2. PAYMENT:
a. To register for and participate in our auctions, you must be at least 18 years old with a valid credit card on file. Bidders under 21 may not bid on handguns.
b. The currency for all purchases is USD.
c. A 20% Buyer?s Premium is added to all winning bids for in-house bidders; rates on third-party platforms are 25%. Third-party platforms may be charged immediately following an auction, and may be subject to additional processing fees charged by LiveAuctioneers/Invaluable.
d. The first time you save a new card to your account, there is a $50 soft charge and void to confirm funds are available, similar to a gas station or hotel. This soft charge falls off as a pending charge for most users within 10 business days, depending on your financial institution and merchant services provider. Alaska Premier Auctions and Appraisals LLC does not receive these funds in any way.
e. Sales Tax: There is no sales tax for this auction.
f. How to pay:
Unless your invoice amounts to more than $3,000, your credit card on file with our company will be charged immediately following the close of the auction. In the event your card isn?t charged immediately, it will be charged within 24 hours of the auction closing. Credit cards accepted include VISA, Mastercard, American Express, and Discover.
For invoices over $3,000, Alaska Premier Auctions and Appraisals LLC accepts:
? Cashier's Check, ACH, Wire Transfer
? Invoices under $3,000 can also be paid via Paypal, Zelle, Venmo, or Cash App, written requests for such must be sent to Admin@AlaskaPremierAuctions.com no later than 24 hours before an auction begins closing to avoid the card on file being charged.
? Invoices that have cards on file decline may be subject to a $15 declined card fee, if we are unable to secure payment by the close of the first pick-up day following the auction ending.
f. You agree not to initiate a chargeback for your purchases under any circumstances. If there is any discrepancy, please give us the opportunity to explore your circumstances by reaching us at Admin@AlaskaPremierAuctions.com. If you initiate a chargeback for any reason, the auction house reserves the right to ban you from future auctions.
g. Transportation, storage, shipping, and handling fees are at the sole discretion of the Auctioneer. Shipping will be billed and collected separately through our third-party service provider, Shipping Saint.
h. Invoices must be paid within 7 business days, failure to pay beyond this deadline, without ongoing communications with our company, may result in being blocked from future bidding. You may be offered a company credit for overpayments or other credits.

i. We reserve the right to refuse service to anyone.


4. LOCAL PICK-UP:
a. TWO DAYS ONLY: 10:00 am - 5:45 pm on Monday & Tuesday, June 29th & 30th. Bring a photo ID and be prepared to present your email invoice receipt of purchase.
b. All inventory is located at our warehouse facility at 325 West Potter Rd. Anchorage, AK 99518.
c. Loading, transportation, and any required disassembly of items is the sole responsibility of the buyer. We do not provide tools for disassembly or assist with moving heavy objects. In some cases, we may require professionally licensed, bonded, and insured movers to load out inventory that is deemed overly heavy for safety purposes.
d. Please call 907.570.7050 in advance to schedule pick-ups beyond the initial two-day window or coordinate shipping arrangements, when applicable for an auction. Not all auctions have flexibility on pick-up dates or have shipping services available. Some deliveries can be made in Anchorage for a minimum $50 fee on a case-by-case basis.
e. We require written permission for all pick-ups on the buyer?s behalf. Email us at Admin@AlaskaPremierAuctions.com or text us at 907.570.7050 to request a substitute pick-up person on your behalf.
f. Any inventory not collected, or without shipping arranged by the close of the second pick-up day will incur transportation and storage fees for a minimum of $25 per lot, per day, for up to seven days.
g. Any inventory remaining in excess of seven days after the close of the auction will be shipped to the address on file at the buyer?s full expense and charged to the card on file unless the cost is deemed unreasonable by the auction house. If deemed unreasonable, the item will be forfeited to the auction house to be relisted, disposed of, or donated at the buyer?s expense.



5. SHIPPING:
a. Our goal is for you to receive your inventory won in our auctions as quickly and cost-effectively as possible while prioritizing the quality and condition of your items. Please note that shipping from Alaska can be costly. While we do our best to minimize costs, it is the sole responsibility of the buyer to cover all costs associated with shipping regardless of expense, including freight items, and insurance.
b. You may select shipping services using Shipping Saint emails and text notifications after the auction. If your item(s) are packed for shipping and you decide to pick-up instead, you will be charged automatically to your card on file for the cost of shipping materials and the handling expense.
c. We package and prepare shipments in-house calculated with the carrier?s shipping costs, any applicable insurance, and signature fees, plus a modest handling fee to cover supplies including bubble wrap, boxes, packing materials, and delivery to the carrier.
d. We do not provide exact estimates. Please use the destination zip code and approximate dimensions of the item(s) as found in the catalog description to prepare an estimate for yourself using an online estimator.
e. Items will be shipped via UPS, USPS, FedEx, Alaska Air Cargo, or other carriers as necessary. We do not use USPS Parcel Select.
f. Contact us at Shipping@AlaskaPremierAuctions.com to make special arrangements, including shipping to an alternate address, or procure your own shipping services.
g. Invoices must be paid in full before shipping is initiated.
h. All items shipped will be insured at their full purchase price at the buyer's expense.
i. All purchases with a combined total value of $300 or more will be shipped with signature confirmation at the buyer's expense.
j. International buyers are responsible for any customs fees or duties on their purchases.

k. International customs declarations for shipped inventory will not be altered from the description we used in the auction listing.
l. We will provide any applicable Tracking Numbers and the total cost of your Shipping & Handling fees through Shipping Saint unless through a freight service.
m. Packages will not be released to the carrier until the balance is paid in full.
n. If your Shipping & Handling fees remain unpaid in excess of 24 hours after packing, you may be charged automatically to your card on file, with possible additional fees to reprint your label and more. If your shipping fees remain unpaid 7 business days following the conclusion of the auction, your items may be forfeited to the auction house to be relisted, disposed of, or donated at the buyer?s expense.
o. Any items with shipping requests will be prepared for shipment and delivered to the carrier within 7 business days of payment. Our shipping department is closed on Saturdays, Sundays, and all holidays.
p. Any issues with the delivery of your shipment must be received by the auction house within 5 business days after the delivery. You must retain the packaging and supply photographs of the shipment for any insurance claims.
For shipments which are more than 10 business days overdue, the auction house must be notified immediately for any further investigative action to be taken.
p. We will not process any recalls for items shipped.
q. Items may be packaged together to reduce shipping costs to the greatest extent possible while maintaining the safety of the items within the package.
r. Certain materials such as ivory, baleen, & other animal products will not be shipped outside of the United States. International buyers may bid on such items but must arrange pick-up or delivery within the United States. It is the bidder?s responsibility to be aware of any additional laws or restrictions for item shipments, many of which are specific and not included comprehensively within the list of items above. We will not violate any federal or country specific laws to make a shipment; and if a legal restriction is the reason for your item not being shipped, your items may be forfeited to the auction house to be relisted, disposed of, or donated at the buyer?s expense.
s. Any firearm shipments must be shipped to a Federal Firearms License (FFL) holder. The buyer is responsible for providing a copy of the destination FFL?s license, plus all Shipping & Handling fees and FFL transfer fees. Black powder and antique firearms (Predating 1898) are excluded from this requirement.
t. We will not ship ammunition.
u. We will not ship alcohol other than wine to select approved states.

6. FIREARM REGULATIONS:
a. Firearms must be paid for and picked up by the buyer registered on our auction platform.
b. Bidders on firearms must be of legal age to do so in their resident state or country.
c. Residents of the United States must be 18 years or older to purchase rifles, shotguns, or any kind of long gun, and also must be 21 years or older to purchase any type of pistols, revolvers, or handguns. Laws may vary between states, know your state and local regulations.
d. Highest bidders of firearms must pass a federal background check and be legally able to possess that type of firearm, please allow time at pick-up to process your background check. Black powder and antique firearms (Predating 1898) are excluded from this requirement.
e. Firearm sales are not considered final until the highest bidder has successfully passed a background check and picked the item up or shipping arranged to an authorized Federal Firearm License dealer.
f. For firearms shipped to an authorized Federal Firearm License dealer, the buyer is responsible for providing a copy of the destination FFL?s license and all FFL transfer fees.
g. If a buyer does not pass their background check or is not approved for any reason, their hammer purchase price will be refunded. Buyer's premium and all additional fees will be forfeit as a result of processing their unsuccessful transaction. The firearm will be kept by the auction house to attempt a sale with the backup-bidder or be sold at a future auction.
h. Bidders who knowingly bid on firearms they may not obtain legally or by background check risk being banned from any and all future auctions with our company.

7. VEHICLE PURCHASES:
a. Vehicles, RVs, and trailers, and other titled items are subject to a $99 title transfer fee, any registration or other fees through the Alaska DMV are additional at cost.
b. Vehicles will only be released to the buyer named on the invoice by appointment with photo ID, unless the buyer provides written release for a designated individual to pick-up in their place. To facilitate the title transfer, you will fill out a Power of Attorney naming Alaska Premier Auctions and Appraisals LLC, and V1 Vehicle Transfer Application form when picking up your vehicle, or mail in completed documentation. Titles will be available for pick up or shipment within 5 business days after your paperwork is completed or received.
c. Vehicle miles are accurate at the time of cataloging, they may change slightly, not to exceed 25 miles beyond what is advertised.
d. Condition notes are given a courtesy, not a statement of fact. We strongly encourage bidders to conduct independent inspection appointments to make final determinations regarding condition, both cosmetic and mechanical. We always strive to disclose known issues and provide extensive photographs and videos to help represent the condition observed but are not mechanics and have minimal time in handling assets. All items are sold as-is, where-is, with no implied warranties or guarantees. We are happy to provide additional condition reports in the form of descriptions, videos or photos upon request, whenever possible. Please email Admin@AlaskaPremierAuctions.com at least 48 hours prior to the auction close with inquiries of this nature.

8. BIDDING ONLINE:
a. All bids placed are final. As a company policy, we do not retract bids. If you default on payment or have your high bid removed for any reason, you will be liable for any difference in sale price between what your high bid was, and the final sale price of the lot.
b. The auction will close at a rate of three lots per minute. If a bid is placed within an item's closing minute, the lot will be automatically extended by one minute.
c. Company Defined Online Bidding Increments: $0 - $50: $5, $51 - $200: $10, $201 - $500: $25, $501 - $1,000: $50, $1,001 - $10,000: $100, $10,001 - $50,000: $250, $50,001 - $100,000: $500, $100,001 - $1,000,000: $1000, $1,000,001 - $5,000,000: $5000, $5,000,001 - $10,000,000+: $10,000
d. Bid increments are subject to change at any time at the auctioneer's discretion.
e. When a user places a Maximum Bid, it will be placed equal to the reserve price if said Maximum Bid exceeds the reserve. If the Maximum Bid amount is below the reserve the bid will be placed for the full amount.
f. The auctioneer reserves the right to lift a reserve price at any time which guarantees a sale to the highest bidder at any price.
g. Being the high bidder on an item, with or without reserve, is a legally binding commitment to purchase the item for the amount of the high bid. This does not include Maximum Bids which exceed the amount of the current high bid.
h. Alaska Premier Auctions and Appraisals LLC is providing Internet auction bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly on the day of the auction. Under no circumstances shall Bidder have any kind of claim against Alaska Premier Auctions and Appraisals LLC or anyone else if the Internet service fails to work correctly before or during the timed or live online auction. Alaska Premier Auctions & Appraisals LLC will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bids are acknowledged should use the website feature and leave their maximum bid 24 hours before the auction ends.
i. Alaska Premier Auctions and Appraisals LLC reserves the right to withdraw, re-sequence, or re-catalog items in this auction at any time, for any reason.

9. CONDITIONS OF SALE:
a. All property is sold ?AS IS?, and ALL SALES ARE FINAL. Bidder agrees that everything is sold as-is and that they may not return any item they purchase. THERE ARE NO REFUNDS.
b. Items may have wear and tear, imperfections, or the effects of aging. Any condition statement given, as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. All dimensions provided are approximate.
c. Buyers are always encouraged to inspect items in person prior to bidding to make their own determinations as to condition, age, size, authenticity, value and any other determining factor by appointment only. Not all inventory will be open for previews. Additional detailed condition reports such as photos, videos, or other, can likely be provided upon request with enough advance notice at least 48 hours prior to auction closing. The bidder shall be the sole judge of value and authenticity and may not make any contest regarding any determining factor. Bidders who participate from off-site and forego the opportunity to be present at the preview understand and acknowledge that this affects their ability to inspect an item as well as if they examined it in person.
d. Alaska Premier Auctions and Appraisals LLC may attempt to describe the merchandise in advertising, on the internet, and at the auction but makes no representations. In no event shall Alaska Premier Auctions and Appraisals LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Alaska Premier Auctions and Appraisals LLC shall endeavor to describe in detail each item and any pertinent information about it.
e. Alaska Premier Auctions and Appraisals LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material misrepresentation of the item itself.
f. Any high/low estimates provided are a courtesy only, and not a guarantee of the sales price.

10. WARRANTIES OF OWNER/REPRESENTATIVE:
a. The owner/representative of consigned inventory warrants that they are the owner or have the right to sell listed items and have merchantable title to the items of personal property offered for sale, hereby granting to the Auctioneer the right to convey a merchantable title to successful high bidder after payment has been received in full. The Owner/representative guarantees clear title, and that liens on the listed property be so stated whereby arrangements will be made so that clear title will be issued to the purchaser. In the event the owner/representative is unable to clear the title within 15 business days following the conclusion of sale, Auctioneer reserves the right to cancel the sale and refund the buyer in full.

11. GOVERNING LAW & VENUE:
a. This agreement is governed by and construed in compliance with the domestic laws of the State of Alaska without giving effect to any choice-of-law or conflict-of-law provision or rule (whether of the State of Alaska or of any other jurisdiction) that would cause the application of the laws of any jurisdiction except the State of Alaska. All disputes related to this agreement shall be resolved in a court of law located in Anchorage, Alaska.

12. ACCEPTANCE:
a. By bidding in our auction the Bidder accepts and agrees that they have read and agreed to the Terms & Conditions of the auction in their entirety. Thank you for your understanding, accordance, and acceptance of these Terms & Conditions.

Highlights of this auction include an important group of 19th-century Alaska Native masks, led by a circa 1875 polychrome Yup'ik animal spirit mask comparable to an example in the Sheldon Jackson Museum, paintings by three members of the celebrated "Alaska Four," including works by Sydney Laurence, Eustace Ziegler, and Jules Dahlager, and a 1957 Chevrolet Bel Air restomod showing approximately 7,000 miles. Collectors will find significant graded comic books including X-Men #1, Giant-Size X-Men #1, Amazing Spider-Man #50, Marvel Spotlight #5, Daredevil #1, and Silver Surfer #4, as well as objects from the collection of pioneering Smithsonian anthropologist Dr. Henry Bascom Collins, Jr. Also featured are important Northwest Coast works from the Bruce Beasley Foundation, including masks by John Livingston and Stan Hunt III, a 19th-century Haida canoe model, and other notable carvings. Further highlights include an original Bob Ross-painted gold pan, a large narwhal tusk, polar bear, brown bear, black bear, and bull moose taxidermy, fine jewelry, and a major James Kivetoruk Moses painting.
