These Terms & Conditions (“Terms”) govern all purchases made through Paul's Estate Sale ("I," “we,” “our,” or “us”), at an in-person estate sale. By entering our sale or purchasing any item, you agree to these Terms.
1. All Sales Are Final
All merchandise is sold AS IS, WHERE IS, WITH ALL FAULTS, without warranties or guarantees of any kind, express or implied.
No refunds, returns, exchanges, credits, or cancellations will be granted.
It is the buyer’s responsibility to inspect all items before purchasing.
Descriptions, photographs, dimensions, and condition reports are provided as a courtesy and are not guaranteed to be complete or error-free.
2. Condition of Items
Items may show wear, damage, repairs, missing parts, or other imperfections consistent with age and use.
We do not guarantee:
Authenticity
Age
Origin
Provenance
Working condition
Completeness
Merchantability
Fitness for a particular purpose
Buyers are solely responsible for determining the condition and value of each item.
3.Errors
We reserve the right to correct:
Listing errors
Photograph errors
Description errors
at any time before delivery or pickup.
4. In-Person Estate Sales
Items are sold on a first-come, first-served basis unless otherwise advertised.
We reserve the right to:
Limit quantities
Refuse service
Remove merchandise
Change pricing
Close the sale at any time
Holding items is not guaranteed unless specifically approved.
5. Payment
Accepted payment methods may include:
Cash
Zelle
Payment is due immediately unless otherwise stated.
6. Item Pickup
Purchased items must be removed during the scheduled pickup period.
Buyers are responsible for:
Loading
Packing
Moving
Transportation
We do not provide moving assistance unless specifically stated.
Bring appropriate labor, tools, and vehicles.
7. Assumption of Risk
Customers enter estate sale properties at their own risk.
Estate sale locations may contain:
Uneven flooring
Stairs
Loose carpeting
Construction materials
Pets
Dust
Fragile items
Limited parking
Other hazards
By entering the premises, customers assume all risks associated with attendance.
8. Release of Liability
The buyer releases and holds harmless:
Property owners
Estate representatives
Volunteers
from any claims arising out of:
Personal injury
Property damage
Theft
Loss of property
Accidents occurring before, during, or after the sale.
9. Children & Pets
Children must remain under adult supervision at all times.
For safety reasons, pets are not permitted unless they are service animals as defined by applicable law.
10. Surveillance
Estate sales location may utilize audio and video surveillance.
By attending or participating, you consent to being recorded for security and loss prevention purposes.
11. Right to Refuse Service
We reserve the right to refuse admission, remove individuals from the premises, cancel sales, or deny future participation to anyone engaging in:
Theft
Harassment
Threatening behavior
Property damage
Fraud
Sale manipulation
Failure to comply with instructions
12. Governing Law
These Terms shall be governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Arizona, and the parties consent to that jurisdiction and venue.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between the buyer and the estate sale owner regarding purchases and participation in estate sales and supersede any prior oral or written agreements on the same subject.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms become effective upon posting at the sale location or on the Estate Sales website.
16. Acceptance
By attending an estate sale, purchasing an item, making payment, or taking possession of merchandise, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
