1. As‑Is, Where‑Is; No Warranties
All property is sold “AS‑IS, WHERE‑IS,” WITH ALL FAULTS, and without any warranty of any kind, express or implied, including but not limited to warranties of condition, merchantability, fitness for a particular purpose, or authenticity. Buyers are solely responsible for inspecting items prior to purchase.
2. All Sales Final; No Returns
All sales are final. No refunds, returns, exchanges, chargebacks, or price adjustments will be permitted for any reason, including but not limited to defects, inaccurate descriptions, or buyer’s remorse.
3. Pricing and Offers
Unless otherwise posted, prices are firm. Any negotiations or discounts are at the sole discretion of the Seller/Estate representative and must be confirmed at the register. In case of any pricing dispute, the decision of the Seller/Estate representative is final.
4. Payment Terms
Accepted forms of payment will be posted at the Sale (for example: cash, approved credit/debit cards, or electronic payments). Payment is due in full at the time of purchase. Buyer is responsible for any applicable sales or use taxes, if required by law.
5. Pickup, Removal, and Abandonment
All items must be removed from the property by the deadline posted for the Sale, or at the time specified on the receipt. Buyer is solely responsible for packing, loading, and transporting all purchases, including providing their own labor and equipment. Items not removed by the deadline may be deemed abandoned and may be resold, donated, or disposed of without refund.
6. Risk of Loss and Damage
Title and risk of loss pass to the Buyer upon payment. The Seller/estate is not responsible for loss, theft, or damage to items after purchase. Buyers are responsible for any damage they or their guests cause to the premises or merchandise prior to leaving the property.
7. Entry, Conduct, and Security
Entry may be limited by posted sign‑in sheet, numbers, or line procedures. The Seller/estate reserves the right to refuse entry or service to any person, to limit quantities, and to ask any person to leave the premises for any reason, including unsafe or disruptive behavior. Children must be supervised at all times. Shoplifters and vandals may be prosecuted.
8. Hold Harmless; Assumption of Risk
By entering the property and/or participating in the Sale, each person voluntarily assumes all risks of injury, illness, or property damage arising out of their presence on the premises or participation in the Sale. To the fullest extent permitted by law, all visitors and buyers agree to RELEASE, HOLD HARMLESS, and INDEMNIFY the estate, personal representative, trustees, heirs, property owner, and their agents from any and all claims, demands, damages, or liabilities arising out of or related to attendance at the Sale, except to the extent caused by gross negligence or willful misconduct.
9. Disputes and Governing Law
Any dispute arising out of the Sale shall be resolved under the laws of the state in which the Sale is held, without regard to conflict‑of‑law principles. Venue for any legal action shall lie in the courts of that state and county, unless otherwise required by law.
10. Modifications and Severability
The Seller/estate may modify posted procedures or rules at any time during the Sale. If any provision of these Terms & Conditions is found unenforceable, the remaining provisions shall continue in full force and effect.
