Killian’s Auction Company, the Auctioneer, conducts public auctions and reserves the right to refuse service to any individual for any reason. By registering to bid, all participants, the Bidders/Buyers, agree to be bound by these Terms and Conditions, as well as any additional terms posted in the auction listing or announced prior to or during the sale.
All items are sold AS IS, WHERE IS, with no warranties or guarantees, express or implied, including any warranty of merchantability or fitness for a particular purpose. Photos, descriptions, and catalog listings are provided as guides only. Buyers are strongly encouraged to attend preview days and inspect items personally before bidding. No sale shall be invalidated due to defects, misdescriptions, or inaccuracies.
The highest bid accepted by the Auctioneer will constitute the winning bid and create a binding contract between the Buyer and the Auctioneer. The Auctioneer’s decisions regarding disputes, bidding increments, and lot re-offers are final and binding. The Auctioneer reserves the right to reject any bid or bidder, to withdraw any lot, or to group or subdivide lots as deemed appropriate.
All bidders must be at least 18 years of age and register with a valid credit card to be approved for bidding. By obtaining a bidder number or placing a bid, the Buyer acknowledges that they have read, understood, and accepted these Terms and Conditions.
A 17% Buyer’s Premium will be added to the final hammer price of all items sold.
Applicable sales tax will be charged based on the location of the auction. For our Hesperia, California location, the current tax rate is 7.75%.
Buyers claiming tax exemption must provide valid resale or exemption documentation prior to payment.
Accepted payment methods include cash, wire transfer, cashier’s check, or debit/credit card. A 4.5% convenience fee applies to all debit/credit transactions. The cardholder must be present for all in-person credit card payments and must present a valid ID. If a buyer reverses a card payment to use another method, a 4.5% fee will be deducted from the refund. All invoices must be paid in full within the pickup period listed in the auction details.
Failure to pay within the allotted time will result in a restocking fee of $100 or 25% of the total invoice, whichever is greater, and may result in suspension of bidding privileges.
Buyers are responsible for all loading, removal, and transport of purchased items. Auction staff cannot assist with loading; buyers must bring all necessary equipment such as boxes, hand trucks, ramps, straps, and help. Pickup must occur within the times specified in the auction listing. Items not removed within the pick up window may be considered abandoned, and the Company reserves the right to resell or dispose of them at its discretion.
Cancellations are permitted within 24 hours of the auction close and are subject to a restocking fee of $100 or 25% of the total invoice, whichever is greater. Failure to pay the cancellation fee will result in the sale being considered final and enforceable.
Killian’s Auction Company offers in-house shipping at the Buyer’s expense. Invoices must be paid in full before packaging or shipping. Accepted payment methods for shipping are credit/debit card, wire transfer, cashier’s check, or personal/business check. Shipments paid by card require a copy of the cardholder’s ID and card. All shipments are sent to the billing address on file. Alternate addresses require payment by wire transfer. Checks require 21 business days to clear before shipment. Shipping quotes must be paid within 48 hours of receipt or items will be deemed abandoned. All shipments are insured and require a signature upon delivery. The Buyer holds the Auction Company harmless for any damage or loss once items are turned over to the carrier. Claims for damage must be filed directly with the carrier.
Failure to pay, pick up, or respond within seven days of the auction close constitutes default. Items will be deemed abandoned, and the Buyer will be charged a 25% restocking fee or forfeiture of the purchase price, whichever is greater.
The Buyer assumes all risks associated with participation in the auction and the use of purchased items. The Buyer agrees to indemnify, defend, and hold harmless the Auctioneer, its affiliates, officers, employees, agents, and consignors from any and all claims, losses, damages, liabilities, and expenses, including attorney’s fees, arising from participation in the auction or use of any purchased item.
By registering, the Buyer consents to the collection and use of personal information for the purposes of conducting the auction and related business. Buyer information will not be sold or disclosed except as required by law or as necessary to complete transactions.
