CONDITIONS OF SALE
These Conditions of Sale apply to every purchase at Pasadena Auction House. Please read carefully.
By registering to bid at auction-in person, through an agent, via absentee bid, telephone, online, or other means, including email--you agree to be bound by these Conditions of Sale (and any updates announced prior to or during a sale). All property and every lot for sale in our catalog is offered under the following terms and conditions, along with any changes published or announced by Pasadena Auction House. The terms "us," "we," or "our" refer to Pasadena Auction House. Unless otherwise stated in the catalog or at the time of sale, Pasadena Auction House acts solely as an agent for the seller. All sales are deemed to occur in California, regardless of whether they take place via telephone, mail, the Internet, or the buyer's physical location.
Definitions
Hammer Price: The highest bid received for a lot when the auctioneer's hammer falls.
Buyer's Premium: The additional amount paid by the buyer as a percentage of the hammer price.
Purchase Price: The total of the hammer price, buyer's premium, applicable taxes, and any other fees required by law.
Reserve: The minimum price at which a lot may be sold.
Buyer: The person or entity purchasing property at auction or private sale.
Consignor: The seller or seller's representative on whose behalf we are selling the property.
Lot: A single item or group of items offered for sale.
Property: The item(s) comprising an auction lot offered for sale.
Participating in Our Auction
You can participate in our auctions in three ways: attending in person, leaving an absentee bid, or bidding online via platforms like Invaluable.com. If you cannot attend but wish to bid, contact us at (626) 404-2422. We can provide condition reports, estimates, and set up absentee or phone bids. The following Terms and Conditions apply to all forms of bidding.
TERMS AND CONDITIONS OF SALE
These Terms and Conditions outline the rules for any purchase ("Sale") conducted through Pasadena Auction House ("Auctioneer"). This includes sales completed in person, online, or via absentee/phone bid. All sales are conducted at the discretion of the Auctioneer, who reserves the right to cancel sales or deny future participation if terms are not met.
Before the Sale
Item Inspection: All items are sold AS-IS. While Pasadena Auction House strives to provide accurate descriptions and commentary, no guarantees or warranties are made regarding the condition, size, quality, rarity, medium, age, authenticity, provenance, or historical significance of any item. Buyers are responsible for their own review of items before bidding. ALL SALES ARE FINAL.
Bidding: Absentee and phone bids are accepted at the Auctioneer's discretion. Buyers must register for absentee or phone bids by 6:00 PM the day before the auction. The Auctioneer is not responsible for missed or unexecuted absentee or phone bids.
Online Bidding: Online bids are accepted at the Auctioneer's discretion via Invaluable.com. Buyers registering to bid online must do so at least 48 hours before the auction date to guarantee approval. Approval of registrations submitted less than 48 hours before the auction is at the Auctioneer's discretion.
During the Sale
Confidential Reserve: All items are subject to a confidential reserve unless otherwise stated.
Auctioneer's Authority: The Auctioneer reserves the right to withdraw any lot, reject bids, or remove individuals from the premises. In the event of a dispute, the Auctioneer's decision is final.
Technology Disclaimer: The Auctioneer is not liable for technological failures or errors affecting online bids.
Payment
Payment Terms: Full payment includes the hammer price, buyer's premium, and applicable taxes. Payments must be received within five (10) business days.
Accepted Payment Methods: Payments can be made via credit card, cashier's check, or bank wire transfer. For international payments, only bank wire transfers are accepted.
Default: If payment is not received within five (10) business days, the sale may be canceled, and the item may be resold.
Storage
Items must be removed within five (10) business days of payment. Storage fees of $5 per day per item will apply for delays, and items left beyond 90 days may be considered abandoned.
Shipping
Pasadena Auction House offers in-house shipping for most items. Buyers will receive an estimated shipping and handling cost after payment is received.
Buyers are responsible for all shipping, packing, customs, and insurance fees.
Buyer is responsible for all insurance claims.
Special Conditions
Jade and Paintings: The Auctioneer cannot guarantee the authenticity of jade or paintings. All items are sold AS-IS.
Endangered Materials: Buyers must comply with all laws regarding the purchase and shipment of items containing materials from endangered species.
Glossary of Terms
Artist or Maker: Indicates the item is, to the best of our judgment, by the named artist.
Attributed to: Indicates probable attribution to the named artist but with less certainty.
Style of/Manner of/After: Indicates the work resembles the named artist but is not by them.
