TERMS OF SALE
These Terms apply to all purchases made through our auction services. By
participating—whether in person, online, by phone, absentee bid, or any other method—you
acknowledge and agree to abide by the policies outlined here. These terms may be amended or
updated at any time before or during a sale. The use of "we," "our," or "the auction house"
throughout refers to the entity conducting the auction.
Unless specifically stated, we act solely as an agent for the consignor. All transactions are
governed under the laws of the State of California, regardless of the location of the buyer or
method of purchase.
KEY DEFINITIONS
Final Bid Price – The highest accepted bid when the auctioneer declares a lot sold.
Buyer’s Premium – An additional percentage added to the final bid, paid by the buyer.
Total Purchase Price – The sum of the final bid, buyer’s premium, applicable taxes, and any
additional charges.
Reserve – A confidential minimum price that must be met for a lot to be sold.
Bidder/Buyer – An individual or entity submitting a bid or making a purchase.
Consignor – The individual or entity that has consigned an item for sale.
Lot – A single item or a grouped set of items being offered at auction.
Property – The actual item(s) included in a lot.
PARTICIPATION TERMS
Participation in our auctions implies acceptance of these Terms of Sale. The auction house
reserves the right to reject or revoke bidding privileges at its sole discretion, cancel any sale, or
deny future participation for any reason.
PRIOR TO BIDDING
All items are sold AS-IS, WHERE-IS. We encourage all potential buyers to inspect the items
beforehand, either in person or via available images and descriptions. While we make every
effort to provide accurate and helpful descriptions, we do not guarantee any information
regarding age, condition, authenticity, origin, materials, or value.
Statements made by staff, consignors, or auction representatives are opinions only and are not
binding guarantees. Buyers are responsible for performing their own due diligence prior to
bidding. All sales are final—no refunds, exchanges, or cancellations will be accepted post-sale.
ONLINE BIDDING
Online bids are accepted through LiveAuctioneers.com or other authorized platforms.
Registration is subject to approval, and we reserve the right to deny access to our auctions
without explanation. We encourage bidders to register at least 48 hours in advance to ensure
timely approval.
We are not responsible for internet interruptions, software failures, or technical delays that may
prevent timely bidding. All online bids are binding and cannot be retracted due to input error or
internet issues.
DURING THE AUCTION
We conduct our auctions in accordance with all applicable commercial and penal codes. Each
lot may carry a reserve, which is confidential unless disclosed. We may withdraw lots, reject any
bid, or remove any individual from the auction process at our discretion.
In case of a dispute over bidding or lot ownership, the auctioneer’s decision is final and binding.
Information regarding any item may be updated or corrected prior to or during the sale, and
such updates supersede previously published details.
PAYMENT
All purchases must be paid in full within five (5) business days of the sale. Payment includes the
final bid, buyer’s premium, and applicable taxes. Accepted forms of payment include PayPal,
bank wire transfer, cashier’s check, credit card, or money order. We reserve the right to hold
items until funds have cleared.
Late payment or failure to pay may result in cancellation of the sale, forfeiture of the lot(s), and
revocation of bidding privileges. Online buyers will receive an invoice via email within 24 hours
after the auction concludes.
Buyer’s Premium: A 27% premium applies to all winning bids.
Credit Card Processing Fee: A 3% surcharge applies to credit card payments.
International Buyers: Payment must be made by wire transfer in U.S. dollars. Foreign checks
are not accepted.
TAXES
Sales tax will be collected as required unless a valid resale certificate is provided or items are
shipped outside California by a licensed carrier.
STORAGE
Purchased items must be removed within five business days of payment. Failure to collect
merchandise will result in storage fees of $5.00 per day per item. After ten days, items will be
deemed abandoned and may be resold or disposed of at our discretion, with proceeds retained
as liquidated damages.
SHIPPING
We use a third-party shipping company for delivery services. Once payment is complete, the
shipping company will reach out directly to coordinate logistics. Buyers may also arrange their
own shipping, but we are not liable for any damage, loss, or delay once items have left our
custody. A release form must be submitted prior to releasing items to any third party.
DISCLAIMER ON AUTHENTICITY
We do not guarantee the authenticity of any item unless explicitly stated. Descriptions, including
details on artist, maker, period, and provenance, are provided as general guidance and are not
binding. Buyers accept the risk that such information may be incorrect or incomplete and must
bid accordingly.
COMPLIANCE WITH LAWS
We adhere to all state and federal regulations regarding the sale of items containing materials
from protected species. It is the buyer’s responsibility to ensure compliance with CITES or other
import/export laws. We do not guarantee the issuance of permits and will not delay or reverse
transactions due to regulatory issues.
FINAL NOTICE
Participation in our auctions constitutes a full and binding agreement to these terms. All sales
are final, and buyers accept all risks associated with purchasing secondhand, vintage, or
collectible items through auction.
