The Curated Warehouse Auction: Spring Edit

Please read our terms and conditions detailed below before bidding. By bidding in this auction, you are acknowledging and accepting the terms and conditions of the sale.

Site Users

Please do not bid if you are unable to pay the winning bid amount along with the buyer's premium, credit card processing fees and applicable sales taxes. By placing a bid, you are also acknowledging that you will be able to pick up the item on the designated pickup date if you are to be the winning bidder.

Item Representations

All items are sold in as-is condition. All listings are meant as a descriptive guide only. Town and Sea will do its best to photograph and portray any damage to items listed on the site in an accurate manner. The absence of descriptions or conditions must not be taken to imply that a lot is in perfect condition. Most items listed on Town and Sea are used, vintage or antique items with signs of wear. Additional condition reports may be available upon request. Town and Sea is not responsible for typographical errors on the site and all measurements are to be considered approximate. Town and Sea will not guarantee the authenticity of any items unless so stated at the time of auction. No in-person previews are available.

Terms of Payment

Town and Sea requires a valid credit card to be added to a registered bidders Live Auctioneers account in order to place a bid in their sale. By providing a credit card, you authorize Live Auctioneers on behalf of Town and Sea to charge your credit card for all auction invoices including buyers premiums, processing fees and applicable sales taxes. All site users must agree to this payment format in order to bid in this sale. Auction items are available for pick up only after the buyers invoice is paid for. Purchase is not contingent upon shipping costs. You must be aware of the shipping costs before you bid on an item.

Buyers Premium

A buyers premium of 18% will be added to the hammer price (winning bid) in all auctions held by Town and Sea on Live Auctioneers.

Sales Tax and Credit Card Fees

All sales are subject to appropriate sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale. Upon receipt of such information, your future purchases will not be taxed. All winning bidders are subject to credit card fees for their online purchases.

Credit Card Information

By providing your credit card information to Live Auctioneers, you authorize Live Auctioneers to auto debit/charge your credit or debit card on file for the purchase amount of any winning bids including the buyers premium, processing fees and applicable sales tax. All sales are final. Town and Sea is not responsible for internet bidding errors or errors with any electronic device. In the event that you fail to pick-up or pay for your items, your item will be considered forfeited and no refunds will be issued.

Refunds

All sales are final. Refunds will only be issued if an item is damaged or lost after the piece has been photographed and prior to the item pickup. We do our best to photograph items to accurately portray the condition, however, if an item was lost or considerably damaged after the item had been listed for sale, Town and Sea will issue a refund to the winning bidder.

Item Pick-Up

Winning bidders must pick up their items on the designated pick up-date advertised during the auction. The city and state of the pickup location will be advertised on the sale and product page during the auction and the pickup address will be emailed to the winning bidders upon the close of the auction. Winning bidders must come with their own packing materials, man-power and appropriate vehicle. For shipper recommendations, please email logistics@townandsea.com. All shippers will be required to pick-up the item on the designated pick up-date advertised during the auction.

Forfeiture of Items

Any items not paid for in accordance with these Terms and Conditions will be considered forfeited. Any items not picked-up in accordance with the designated auction pick-up dates and times will be considered forfeited. If an item does not fit into a winning bidder's vehicle on the day of the pick-up, that item will also be considered forfeited if the winning bidder is unable to transport the piece within the time window of the pickup date. Town and Sea, with the Seller's permission, can re-offer forfeited items for sale or donate the items to charity.

Intellectual Property

Unless otherwise stated, Town and Sea LLC and/or its licensors own the intellectual property rights for all material on www.townandsea.com. You must not republish material, sell, rent, sub-license, reproduce, duplicate, copy or redistribute content from Town and Sea.
