By registering, bidding, purchasing, or participating in any sale conducted by Blackwell Auction Group, Inc. (“Blackwell”), you acknowledge and agree to the following Terms & Conditions, together with any additional terms posted for the individual sale.

1. ALL PROPERTY SOLD AS-IS, WHERE-IS

All items are sold AS-IS, WHERE-IS, with all faults and without warranties or guarantees of any kind, expressed or implied, except where expressly stated in writing by Blackwell.

Descriptions, photographs, measurements, condition reports, provenance, dates, attribution, authenticity, and other information are provided in good faith for identification and informational purposes. Buyers are responsible for reviewing photographs, descriptions, and available information and asking questions prior to bidding or purchasing.

2. CONDITION

Most estate and consignment property is pre-owned and may exhibit age-related wear, scratches, discoloration, repairs, losses, damage, odors, or other imperfections.

Photographs are considered part of the item description. The absence of a condition statement does not imply that an item is free from defects.

3. BIDDING & PURCHASES

All bids are binding. By placing a bid, the bidder acknowledges that they have reviewed the item and agree to purchase it if declared the winning bidder.

Blackwell reserves the right, to the extent permitted by applicable law and platform rules, to reject or cancel bids, withdraw or combine lots, correct errors, or resolve bidding disputes.

4. BUYER’S PREMIUM, TAXES & PAYMENT

A buyer’s premium may be added to the hammer price or purchase price. The applicable buyer’s premium, payment methods, sales tax requirements, processing fees, and other sale-specific charges will be disclosed in the individual auction or sale terms.

Buyers are responsible for all applicable taxes unless a valid exemption is provided and accepted.

5. PICKUP & REMOVAL

Buyers are responsible for reviewing pickup dates, times, and locations before bidding.

Purchases must be removed during the designated pickup period unless Blackwell approves other arrangements in writing. Buyers are responsible for providing any labor, tools, packing materials, equipment, or transportation necessary to safely remove their purchases.

Failure to pick up property within the stated timeframe may result in storage charges, forfeiture, disposal, resale, or other remedies permitted by the sale-specific terms and applicable law.

6. SHIPPING

Shipping is not automatically available for every item. Buyers must review each auction or item listing to determine whether shipping is offered.

When shipping is available, all shipping, handling, packing, insurance, and related costs are the responsibility of the buyer unless otherwise stated.

Blackwell reserves the right to decline shipment of any item that cannot reasonably or legally be shipped.

7. ACCURACY & ERRORS

Blackwell makes reasonable efforts to provide accurate information; however, errors or omissions may occur. Blackwell reserves the right to correct typographical, photographic, cataloging, clerical, or technical errors when discovered, subject to applicable law and platform rules.

8. TECHNOLOGY & ONLINE BIDDING

Blackwell is not responsible for internet interruptions, platform outages, software failures, delayed bids, device problems, or other technical issues beyond our reasonable control.

Bidders are encouraged to place bids early rather than waiting until the final moments of an online auction.

9. FAILURE TO PAY

Winning bidders are responsible for completing payment according to the terms of the applicable sale. Failure to pay may result in cancellation of the transaction, suspension from future auctions, collection efforts, or other remedies available under applicable law and platform rules.

10. SALE-SPECIFIC TERMS

Individual auctions may contain additional or modified terms regarding buyer’s premiums, payment, shipping, pickup, removal, storage, restricted items, or other matters.

Sale-specific terms supplement these general Terms & Conditions and should be reviewed carefully before bidding.
