QUARK’S TREASURE – ONLINE ONLY AUCTION TERMS AND CONDITIONS
ITEM PICKUP: SUNDAY, JULY 20TH, 2025
(Unless shipping is requested prior to that date)

1. TERMS OF PAYMENT
Purchasers agree to pay the total amount due within 24 hours of auction close. All items must be paid in full before pickup or shipment. Only PayPal payments are accepted. No cash payments at pickup will be accepted unless explicitly stated in the auction listing. Failure to complete payment within the allotted timeframe will result in penalties and forfeiture as detailed below.

2. ITEM PICKUP
On-location pickup is required on the stated date. No exceptions. Failure to pick up will result in a $25–$50 NO-SHOW or LATE PICKUP FEE. If you cannot pick up or do not want to pay for shipping, do not bid.
Bring your own boxes, packing materials, tools, and labor—we will not load your vehicle.

3. SHIPPING
We offer in-house shipping for smaller items. Shipping must be requested prior to the pickup date.

Items left unclaimed after 30 days become the property of Quark’s Treasure with no refunds issued.

NO HANDLING FEES BECAUSE THAT'S JUST A RIP OFF

No advance shipping estimates will be provided.

Items will not ship until all charges are paid in full, including shipping and any applicable insurance.

All shipping claims must be submitted within 3 business days of delivery.

4. TERMS & CONDITIONS OF SALE
By bidding, you agree to these Terms & Conditions. Acceptance of a bidder number or registration implies full agreement. Quark’s Treasure is not responsible for bidding errors (e.g., bidding on the wrong lot).

5. BUYER'S PREMIUM & SALES TAX
A 13% buyer’s premium is applied to all winning bids.
Florida residents will be charged 7% sales tax, calculated on the hammer price plus buyer's premium.

6. PAYMENT METHODS
All payments must be made via PayPal only. Invoices will be emailed after the auction ends. Pay promptly within 24 hours. No alternate payment methods or pay-at-pickup options unless otherwise stated.

7. NON-PAYMENT
Failure to pay will result in:

A $35 late fee and $35 per additional week

Legal action for the total amount due, including interest, attorney’s fees, and costs

Cancellation or resale of items, with the defaulting buyer liable for deficiency

Permanent ban from future auctions

Retention of any items the buyer owns in our possession as collateral

8. WITHDRAWAL RIGHTS
Quark’s Treasure reserves the right to withdraw any item before the auction closes.

9. TECHNOLOGY ISSUES
If software or internet issues occur after lot closing, we reserve the right to reopen bidding. Otherwise, closed lots are considered final.

10. DISPUTES & AUCTIONEER AUTHORITY
Quark’s Treasure has final authority in all bidding disputes. Our records are conclusive.

11. FAILURE TO DELIVER
If we are unable to deliver items due to unforeseen issues (e.g., theft, fire), our liability is limited to the amount paid by the buyer—no additional compensation will be offered.

12. REPRESENTATIONS & WARRANTIES
All items are sold AS IS / WHERE IS with no guarantees, warranties, or implied representations, including title, condition, or authenticity.

13. RESERVES
Some lots may be subject to a reserve (minimum sale price). We may bid on behalf of the seller up to the reserve price.

14. ABANDONED LOTS
Items not picked up or paid for by the deadline will be considered abandoned, with no refunds. Quark’s Treasure may dispose of these items as deemed appropriate and may assess disposal fees.

15. DISPUTE RESOLUTION
Any disputes must go through mediation first, followed by binding arbitration in Duval County, Florida, as per American Arbitration Association standards.
No legal action may be initiated without completing mediation and arbitration.
Buyer agrees that mediation fees will be their responsibility. Non-payment by buyer may be pursued directly in court without mediation.

16. LIMITATION OF LIABILITY
Quark’s Treasure makes no warranty or guarantee on any item’s merchantability, title, authenticity, or fitness for use. No liability is assumed for any incidental, consequential, or punitive damages.

Local pickup is our preferred option. Shipping is available for certain items at the buyer's expense. Look for items marked as shippable. We handle shipping in-house and use only USPS and UPS. Please note that there is a $5 handling fee per invoice, NOT PER LOT.

Once you have paid your sale invoice, you will receive a separate invoice for the shipping charges. Depending on the sale's size and the amount of shipping involved, it may take several days after pickup before you receive the shipping invoice.

If you require shipping, please send an email to auctions@Lab33inc.com so that we are aware that you will not be picking up your items.

All items must be paid for before they are shipped.
