Terms and Conditions of Auction Sale
Dovetails LLC dba Auctions Neapolitan
The following, together with any posted notices or verbal announcements made during the auction, constitute the entire terms and conditions on which property shall be offered for auction sale by Dovetails LLC dba Auctions Neapolitan (?Auctioneer or Auction House) and any consignor / Seller (collectively We or Us). Registering to bid or attending the auction indicates full understanding and acceptance of these terms and agreement to be bound by them.
1) Governing Terms
These terms control this auction in all regards and supersede all previous announcements, advertisements, and published information except for any announcement made by the Auctioneer during the auction, which shall take precedence. Auctioneer acts solely as agent for the Seller and is not an agent for any Bidder or Buyer.
2) Bidder Eligibility
All bidders must be at least 18 years of age and legally competent to enter into a binding contract. By registering, the bidder represents and warrants that they meet these requirements. Auctioneer may require government-issued photo identification.
3) Registration
Bidder must register with Auctioneer before bidding. Proper identification is required. Internet bidders must provide a valid credit card and expressly authorize Auctioneer to charge the full invoice amount if payment is not received within the time allowed.
Bidders are solely responsible for safeguarding their bidding number, credit card information, and passwords. Any bids or purchases made using a bidder?s number are the sole responsibility of the registered bidder.
Auctioneer reserves the absolute right to refuse registration to any prospective bidder for any reason, to limit bidding, and to remove any person from the premises. Removal or violation of these terms may result in the immediate cancellation of the bidder?s registration and/or the voiding of any or all bids placed by that bidder, at Auctioneer?s sole discretion. Such decisions are final.
4) Buyer Premium
A 25% Buyer Premium is in effect for this auction. 25% will be charged on all purchases and will be added to the highest bid to determine the final price. The applicable Buyer Premium rate(s) and any platform fees will be clearly posted on the auction catalog, website, and announced prior to the start of the auction. In-house bidders paying in full by cash or check within 3 business days may qualify for a discounted premium rate. Any additional platform or third-party credit-card or other fees are passed through directly to the buyer.
5) Descriptions
Catalogs, brochures, descriptions, and all other auction materials are provided for guidance only. They are based on information believed to be reliable but are not guaranteed or warranted in any way. Auctioneer and Seller make no representations or warranties regarding accuracy, completeness, condition, authenticity, or any other matter. Bidders must rely solely on their own inspection and due diligence. Auctioneer and Seller shall not be liable for any errors, omissions, or inaccuracies.
6) Withdrawal and Increments
Auctioneer reserves the absolute right to withdraw any lot or portion of a lot from the auction, to cancel the entire auction, or to change the order of sale at any time, with or without notice, and without any liability. Auctioneer may also set or change minimum bidding increments in its sole discretion.
7) Condition of Property
All lots are sold ?AS IS, WHERE IS? with all faults, defects, wear and tear, and imperfections. Auctioneer and Seller make no warranties or guarantees whatsoever, express or implied, including but not limited to merchantability, fitness for a particular purpose, condition, authenticity, or suitability. Bidders must carefully inspect each lot prior to bidding. ?Good condition? means average for its age and use with normal wear ? it does not mean perfect or free of defects. All measurements are approximate. By bidding, each bidder acknowledges that all lots were available for inspection and that they have relied solely on their own inspection or that of their chosen independent professional. Bidders assume all risk regarding condition, authenticity, and description.
8) Sale and Contract Formation
The highest bidder recognized by the Auctioneer will be the Buyer, subject to any reserve price being met. A lot is sold when the Auctioneer indicates its sale in the customary manner (hammer fall or equivalent announcement). Upon sale, a binding and enforceable contract is immediately formed between the Buyer and the Seller. The Buyer agrees that no further writing or documentation is required to create a valid and enforceable contract.
9) Opening Bids
Lots will typically open at approximately one-half of the low estimate. Auctioneer reserves the sole and absolute right to open bidding at any amount, to raise or lower the opening bid, or to start bidding at zero, at its discretion.
10) Absentee and Proxy Bids
Absentee, phone, proxy, and internet bids are accepted as a convenience to bidders. All absentee bids must be received by Auctioneer no later than the day before the auction begins. While Auctioneer will make reasonable efforts to execute absentee bids, neither Auctioneer nor Seller is liable for any failure to execute such bids for any reason, including human error, technical issues, or miscommunication. It is solely the bidder?s responsibility to confirm that all absentee bids are properly placed and to cancel any absentee bids if they choose to bid in person, by phone, or by any other method.
11) Bidding Disputes
In the event of any dispute between two or more bidders, Auctioneer?s clerking records shall be conclusive and binding. If a dispute arises before the clerking records are completed, the decision of the Auctioneer shall be final and binding in all respects and not subject to challenge.
12) Title and Risk of Loss
Ownership and title to each lot pass to the Buyer only upon full payment and clearance of all funds. Risk of loss, damage, or theft passes to the Buyer immediately upon the fall of the hammer (sale confirmation), even if the lot remains on Auctioneer?s premises. Buyers are solely responsible for their purchases from the moment of sale. Neither Auctioneer nor Seller shall have any liability for loss, theft, damage, or specialty storage of any lot after the sale is announced. Lots may not be removed from the premises until full payment is received.
13) PAYMENT TERMS
a) Sales Tax: Florida state sales tax is 6%. Sales tax will be added to all purchases picked up or delivered in Florida unless the buyer has a current, valid Florida Annual Resale Certificate on file with Auctioneer prior to the auction. Florida does not accept out-of-state resale certificates. Out-of-state shipments are subject to the tax rules of the destination state.
b) Payment Due: Full payment is due immediately. However, buyers are allowed a reasonable time to pay by cash, check, or wire transfer. By registering to bid online, you authorize Auctioneer to charge the credit card on file for the full invoice amount if payment has not been received within the time allowed.
c) Accepted Payment Methods: Cash or check (in-house); Credit card (in person only - must be physically swiped or tapped with valid ID); Wire transfer (for invoices over $3,000). Credit cards are not accepted by phone, fax, or email. A convenience fee applies to all credit card and wire payments (retained by the processing company, not Auctioneer).
d) Late Fees & Charges: $50 fee for any failed or returned payment. Finance charge of 2% per month (24% per annum) on unpaid balances beginning 7 days after the auction date. Additional $10 late fee after 30 days.
e) Collection: If any account remains unpaid, Auctioneer and/or Seller may pursue all legal remedies. Buyer agrees to pay all costs of collection, including reasonable attorney fees of up to 33 1/3% of the amount due, plus accrued finance charges.
14) SHIPPING AND PICK-UP
All shipping, packaging, transportation, insurance, taxes, duties, and related fees are the sole responsibility of the Buyer.
Auctioneer may, at its discretion, ship small, non-fragile items via USPS Priority Mail insured within the continental United States. Buyers may use any shipper of their choice.

Storage Fees: Lots remaining on the premises after 14 days will incur a storage fee of $10 per lot per day, added to the buyer?s invoice and due immediately. Items not removed within 60 days may be considered abandoned. Auctioneer reserves the right to sell such items by any means to recover all outstanding amounts. The current commission rate will be deducted from proceeds along with all fees. Any remaining balance will be refunded to the buyer at the address on file. Buyers facing shipping delays must notify Auctioneer in writing prior to the 14-day deadline to request an exception.
15) SAFETY AND RESPONSIBILITY
All persons attending the auction or preview assume all risks of injury, loss, damage, or death arising from or related to the auction premises or activities. Auctioneer and Seller shall not be liable except in cases of their own gross negligence or willful misconduct. Each attendee agrees to indemnify, defend, and hold harmless Auctioneer and Seller from any claims caused by their own actions or negligence.
16) Consignor Bidding
Consignors (Sellers) are not permitted to bid on their own property unless the intent is to purchase and such bidding is expressly disclosed to all bidders prior to the start of the auction.
17) Photography and Recording
No photography, video recording, or audio recording is permitted without the prior express written consent of Auctioneer.
18) Force Majeure
Auctioneer and Seller shall not be liable for any failure or delay in performance due to fire, flood, storm, act of God, war, terrorism, strike, labor dispute, pandemic, government order, or any other cause beyond their reasonable control.
19) GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the State of Florida. Exclusive venue for any dispute shall be in Collier County, Florida. Any controversy or claim (except collection actions) shall be resolved by final and binding arbitration in Collier County, Florida, under American Arbitration Association rules. The parties waive any right to a jury trial. The prevailing party shall recover reasonable attorney?s fees and costs. Notwithstanding the above, Auctioneer and Seller retain the right to file a traditional lawsuit in Collier County courts solely for collection of unpaid balances.
20) COLLECTION ACTIONS
In any collection lawsuit, the defaulting Buyer agrees to pay all costs of collection, including reasonable attorney?s fees of up to 33 1/3% of the amount recovered, plus accrued finance charges.
21) Bid Rigging and Illegal Conduct
Bid rigging and collusive bidding are serious federal crimes. Any suspected illegal conduct will be immediately reported to the U.S. Attorney and Department of Justice. Penalties under Title 15, Section 1 of the U.S. Code include substantial fines and imprisonment.
22) Severability and Entire Agreement
If any provision of these terms is held invalid or unenforceable, the remainder shall remain in full force and effect. These terms constitute the entire agreement between the parties and supersede all prior understandings.
