# C&C Auctions – Estate Sale Terms & Conditions

These Terms apply to all attendees and purchasers at any C&C Auctions estate sale (“Sale”). By entering the premises or purchasing any item, you agree to these Terms.

## 1) Entry & Conduct

* Entry may be limited to manage capacity and safety. Follow posted signs and staff instructions.
* Children must remain with an adult at all times. No smoking, vaping, or pets (service animals excepted).
* C&C Auctions may refuse service or remove any person for disruptive or unsafe behavior.

## 2) Condition of Items – **AS-IS, WHERE-IS**

* All property is sold **AS IS, WHERE IS**, with **no warranties**—express or implied—including, without limitation, warranties of condition, merchantability, fitness for a particular purpose, safety, or authenticity.
* Descriptions, photos, measurements, and statements (written or verbal) are provided as a **guide only** and are not guarantees.
* It is the buyer’s responsibility to **inspect** items **before** purchase. **All sales are final. No refunds. No returns. No exchanges.**

## 3) Pricing & Availability

* Prices are as marked or as announced by staff and may change without notice.
* Items may be withdrawn from the Sale at any time at C&C Auctions’ discretion.

## 4) Payment

* **Accepted payment methods:** **Cash** and **credit card** (major cards).
* Valid photo ID may be required for card transactions.
* **No chargebacks** or payment reversals for any reason; by purchasing, buyer waives the right to dispute charges with the card issuer for condition, fit, or buyer’s remorse.
* Applicable sales tax will be collected where required by law (resale certificates must be presented **at time of purchase**).

## 5) Pick-Up, Removal & Loading – **Bring Your Own Help**

* **Buyer must provide all labor, tools, and equipment** needed to disconnect, pack, move, and load items.
* **C&C Auctions staff do not lift, load, or secure items** and do not supply dollies, blankets, straps, or tools.
* **All purchases must be removed by** the end of the Sale or by the **posted pick-up deadline** [insert date/time]. Items not removed on time may be **forfeited without refund** and/or subject to storage/handling fees.
* The **risk of loss and damage transfers to buyer** at the time of payment/possession, whichever occurs first. Buyer is responsible for safely transporting items off-site and for any damage caused during removal.

## 6) Appliances, Electrical, Fixtures & Installed Items

* Buyer is responsible for proper disconnection and compliance with applicable codes. No guarantees as to completeness, accessories, or compatibility.

## 7) Claims & Hold Harmless

* Entering the property and handling merchandise involves inherent risks (e.g., steps, cords, heavy objects, glass, tools).
* **Buyer/attendee assumes all risk** of injury, loss, or property damage and agrees to **release, defend, and hold harmless** C&C Auctions, the property owner, and their agents from any and all claims, liabilities, or damages arising from attendance, purchase, or removal of items.

## 8) No Returns / No Refunds

* **All sales are final.** No refunds, returns, exchanges, or partial credits for any reason after purchase, including but not limited to condition, completeness, fit, or function.

## 9) Security & Property Rules

* Premises may be monitored by video. Bags and large coats may be subject to inspection.
* Do not remove price tags or “SOLD” tags other than on your own purchases.

## 10) Disputes & Remedies

* In the event of a pricing or ticketing dispute, **C&C Auctions’ decision is final**.
* If a transaction cannot be completed for reasons within buyer’s control, C&C Auctions may cancel the sale and resell the item, without liability beyond refunding the purchase price (if already paid).

## 11) Privacy

* Transactions may be recorded for internal records and compliance. By attending, you consent to incidental photography/videography for security and marketing.

## 12) Governing Law

* These Terms are governed by the laws of the state in which the Sale occurs. Any dispute shall be brought in the courts of that state/county.

## 13) Acceptance

* Your entry to the Sale premises or purchase of any item constitutes your **acknowledgment and acceptance** of these Terms.
