The terms and conditions found on our website at https://www.donleyauctions.com/terms-conditions constitute the final and definitive agreement for all auctions. The summary provided below is for convenience; in the event of any conflict, the website version shall prevail.

INTRODUCTION
These Terms and Conditions of Sale govern all auctions conducted by Donley Auction Services, including those conducted online, via absentee bid, by phone, and in person. Donley Auction Services acts as an agent for consignors. Any announcements made by the auctioneer on the day of the auction take precedence over any printed or online information.

1. BINDING CONTRACT
When you bid on any item, you are entering into a binding contract. By registering and bidding, you agree to accept these terms and conditions.

2. DISCLAIMER: MULTIPLE BIDDING PLATFORMS
Donley Auctions uses multiple bidding platforms (e.g., Our House Platform, LiveAuctioneers, Proxibid, and In-House). To ensure transparency, bidders should be aware:

Competing Bids: Absentee bids on one platform may compete with bidders on other platforms.

Real-Time Delays: Platforms are not always synchronized. You may not be the high bidder even if your screen indicates you are, as the auctioneer may have accepted a bid from the floor, a phone, or another platform.

Tie Bids: In the event of identical bids, the Auctioneer has sole discretion to accept the first bid recognized.

Recommendation: To avoid disappointment, we encourage bidding LIVE or placing maximum absentee bids well in advance.

3. ITEM DESCRIPTIONS & CONDITION ("AS IS")
All Sales Final: All property is sold AS IS. There are absolutely NO REFUNDS, EXCHANGES, OR RETURNS.

No Warranties: Donley Auctions makes no warranties of merchantability or fitness for a particular purpose. The bidder is the sole judge of value, condition, and authenticity. The absence of a condition report does not imply the lot is perfect.

Inspections: Descriptions and photos are a courtesy. We strongly encourage in-person inspections. It is the bidder?s responsibility to request condition reports via email at Info@DonleyAuctions.com BEFORE bidding.

Errors: Donley Auctions is not responsible for errors or omissions unless they constitute a material and intentional misrepresentation.

4. PAYMENT POLICY
Invoicing: Invoices are sent shortly after the auction concludes.

Deadline: Payment is due within 24 hours of the auction end.

Payment Methods: We accept major credit cards. To pay via Cash, Cashier's Check, or Money Order (to avoid processing fees), you must contact the office at 815-923-7000 within 24 hours.

Mailing: Cashier's Checks or Money Orders must be sent via Priority or Express Mail within 5 days.

Autopay: For platforms with Autopay, cards will be charged automatically 72 hours after the auction if no other arrangements are made.

Sales Tax: Calculated based on the destination address unless a valid resale certificate is on file prior to the auction.

Declined Payments: If a card is declined, the bidder must provide a new payment method immediately. We reserve the right to file "Non-Paying Bidder" disputes or issue permanent bans for unresolved payments.

5. AUCTIONEER DISCRETION
Donley Auctions reserves the right to withdraw or re-catalog items, end an auction early, or extend an auction due to technical issues or unforeseen circumstances.
