Auction Conditions of Sale
1. Agency & As-Is Condition
Except as otherwise stated, Aaron's Estate Sales LLC d/b/a Block Auction House (?Block?) acts solely as agent for the seller. The contract for sale is between the buyer and the seller. All property is sold as is, where is, and neither Block nor the consignor makes any warranties or representations of any kind, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, or accuracy of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition. No statement?oral or written?made in the catalog, at the sale, on the invoice, bill of sale, or elsewhere shall be deemed a warranty, representation, or assumption of liability.
2. Bidder Registration
All prospective bidders must register with Block prior to bidding and may be required to provide identification and/or financial references. By registering, bidders assume personal responsibility for payment of all purchases, including the hammer price, buyer?s premium, applicable sales tax, and shipping or handling charges.
3. Acceptance of Terms
Bidding on any item constitutes acceptance of these terms and conditions, as well as any additional terms posted online or announced at the sale. These terms apply regardless of bidding method: in-person, phone, absentee, or internet.
4. Reserves & Bidding on Behalf of the Seller
Certain lots may be subject to a reserve, which is the confidential minimum price agreed upon between the consignor and Block. In accordance with Uniform Commercial Code ?2-328, Block, as auctioneer, reserves the right to bid on behalf of the seller. Any such bids are executed with the intent to reach the reserve or to stimulate legitimate bidding interest. These bids may be placed by the auctioneer or a Block representative during the course of the auction. The auctioneer has sole discretion to open bidding, advance the bidding in such increments as they deem appropriate, and reject bids that are not commensurate with the value of the lot. In the absence of a reserve, bidding typically opens at 50% of the low estimate.
5. Buyer?s Premium & Invoicing
The final purchase price includes the hammer price plus the buyer?s premium, applicable sales tax, and shipping (if requested). A second invoice for shipping will follow within 3?5 business days of the auction close.
6. Shipping & Handling
Shipping is billed separately. Please review our shipping policies before bidding. Contact info@blockauctionhouse.com to arrange for local pickup at 2440 Goodrich Rd, Ferndale, MI 48220. All packages are insured; however, Block is not responsible for items lost, stolen, or damaged after delivery. Claims must be filed with the carrier?s insurer.
Labor and Supply Charges: Begins at $15 per lot, but may increase based on size, fragility, and complexity.
Paintings/Prints: $75 flat labor charge, plus materials and shipping.
Custom/Freight: We do not offer freight shipping in-house. Buyers must arrange freight for oversized items.
7. Title & Risk of Loss
Title to the item passes upon full payment. Risk of loss transfers upon delivery to carrier or buyer pickup.
8. Auctioneer Discretion
The auctioneer has the sole and final discretion to determine the winning bidder, to reject any bid, to resolve bidding disputes, or to reopen bidding if necessary.
9. Bidding Methods
Block offers absentee, phone, and internet bidding as a courtesy and does not guarantee the execution of any bids. Identical absentee bids are awarded to the earliest received. Telephone bidders should leave backup bids in case of connectivity issues.
10. Pickup, Storage & Forfeiture
All purchases must be paid for and picked up, or paid for with in-house shipping arranged, within 10 business days of the auction's close. After this period, a storage fee of $10 per lot per day will be applied. Block is not liable for loss or damage to items left beyond this period. After 30 days, uncollected items may be resold without reserve. All fees assessed, including storage fees, are non-refundable.
11. Refunds & Returns
All sales are final. Refunds or returns are granted only at Block?s sole discretion.
12. Default & Remedies
If a buyer fails to pay or otherwise breaches these terms, Block may pursue all available legal remedies, including resale of the item at public auction without reserve. The defaulting buyer is liable for any resulting deficiency and expenses, including legal fees.
13. Liability Limitation
In no event shall Block?s liability to any purchaser exceed the amount actually paid for the item by that purchaser.
14. Taxes
Sales in Michigan are subject to state sales tax unless a valid exemption certificate is provided prior to the auction.
15. Copyright
The purchase of a lot does not grant any copyright or reproduction rights. All catalog content, images, and written materials are the property of Block Auction House and may not be used without prior written consent.
16. Governing Law & Venue
These terms are governed by the laws of the State of Michigan. Any legal action arising under or related to these terms shall be brought in the courts of Michigan, and bidders consent to the jurisdiction of such courts.
