R&R Estate Liquidation Services LLC. further on as *Agent* agrees to conduct an on-site estate/tag sale at listed location by advertising and inviting potential buyers to attend a pre-priced on-site sale using traditional tag sale format. Agent will act on best efforts basis to obtain a fair and reasonable price for the items. Agent will perform the following services:
Advertise sale – newspaper and online.
Promote sale on estate sale web sites.
Promote sale and items via social media.
Place appropriate signs directing buyers to sale location.
Secure any necessary permits where required.
Organize, display and make all the merchandise accessible.
Supply tables, racks, shelves & display cases for the sale.
Research unique items to get a fair market price.
Price all valuable items with attention to ascertain the fair market price.
Negotiate and “make deals” assuring a fair price and fast sale.
Record sale and reconcile the cash result.
Estate Sale Personnel will send a cashier’s check and or money order with net proceeds from the sale within five business days after sale, along with the sale records.
OTHER PROVISIONS CONCERNING THE CONDUCT OF THE SALE:
1. The agent will set the dates and hours of the sale.
2. The agent will have full access to the property on which the sale is conducted.
3. Seller should not be present during the selling hours of the event and should not interfere with the conduct of the sale or the negotiation with the buyers.
4. The Agent reserves the right to withdraw from sale if homeowner and/pr family members become hostile or homeowner refuses to comply with contract or safety is an issue. All time and expenses incurred are due and payable should this transpire.
5. Agent and agent’s designated sales personnel will have the sole authorization to set prices, to discount and/or renegotiate prices with buyers. Agent may at discretion to leave certain items unpriced and will invite conversation and negotiation. Agent makes no promises or guarantees regarding proceeds that will be generated from the sale.
6. Agent will make a reasonable effort to prevent breakage and theft; however, agent will not be responsible for payment or replacement of any items rendered unsalable by these causes.
7. The Agent may accept personal and business checks tendered by those known by or properly identified to the agent. All checks are subject to the rules and regulations of the State of Michigan and the bank in which they are deposited.
8. Sale taxes will be collected by the Agent and reimbursed to the State of Michigan.
9. Homeowners insurance will be in force on the location property at the time of the sale.
10. Client is responsible for ensuring that utilities: water, power, heating, and air conditioning will be in place and operational during set up, sale and clean out if applicable.
11. Any required maintenance for safe access to the sale is the responsibility of the client.
12. Any items removed from the sale for any reason by the Client are subject to Agent’s full commission.
13. Buyers are solely responsible for the removal of the property they purchase and are required to remove items purchased before the end of the sale.
14. Agent is not responsible for damage to the property caused by the buyers during the removal of their merchandise or during the conduct of the sale.
15. Seller will provide title and/or the bill of sale for any property which by law or common practice requires these documents. (Auto, boat, etc.)
16. Agent will not be responsible for any damage to the remaining merchandise incidental to transporting said items to auction houses, other sale venues or charities.
17. This agreement is subject to the laws of the state in which the sale is conducted.
18. Any agreement to alter the terms and conditions of this agreement does not affect the validity of any of the other provisions.
19. In the event of a dispute between the Seller and the Agent, the parties agree to settle by professional mediation.
20. Seller certifies they are the rightful legal owner of the property to be sold and/or are the authorized legal agent for the rightful owner.
COMMISSION SCHEDULE
$0 to $5,000 commission is 30% with a minimum of $1,000, whichever is greater
$5,000 to $10,000 commission is 25%
$10,000 and above commission is 20%
Advertisement other than online is paid for by the consignee from sale proceeds. There are generally no packing fees or other personnel fees unless otherwise stated on the contact. Circumstances of each estate will determine if such is needed.
