Terms & Conditions: We want our bidders to have a good experience and feel confident bidding on any Lot in the auction. Buyers must accept the following Terms & Conditions to participate in the online live auction. By signing up as a bidder, you acknowledge that you have read and understood our Terms & Conditions and agree to abide by them. Please make sure you have a credit card on file before registering for the auction. All items are SOLD AS IS, with NO RETURNS. If the bidder would like additional photos of a certain lot, please contact gallery at info@artleaders.com.

Total Sales Price: The total sales price of an item includes the hammer price plus a 25% buyer's premium. Packing, shipping, and insurance are extra unless stated otherwise.

Bidding Registration: A prospective buyer must complete and sign a registration form and provide identification before bidding. We will require a credit card on file.

Bidding: When making a bid, the bidder is accepting personal liability to pay the purchase price, including the 25%-30% buyer's premium. If the bidder is acting as agent on behalf of an identified third party, Art Leaders Gallery will only look to the principal for payment.

Absentee Bids: The Auction Catalogue will be open for 2-4 weeks before going to live auction. All Bidders who are unable to attend the live auction will be directed to place an absentee bid on Live Auctioneers during the 2?3 week period prior to the live auction. Art Leaders Gallery will not accept written bids at the gallery. Bids can only be placed on Live Auctioneers. Execution of absentee bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute an absentee bid or for errors and omissions in connection with the bid.


Certificate of Authenticity (COA): Most artworks listed in the catalog will be shipped with a Certificate of Authenticity and Artist Biography. Please see desired lot description to verify.


Payment Due: Art Leaders Gallery (The Seller), will contact the Buyer within three (3) days of the completion of the auction. Complete payment is due upon receipt of the invoice no later than 7 days after it is received. Title of ownership shall pass to the Buyer once payment in full has been made. All shipping charges will be paid by the Buyer. Any item(s) that has not been paid within 7 days after invoicing may be put back on the auction block for sale. Bidders? unknown to Art Leaders Gallery may be asked to provide additional personal identity or banking information.

Autopay: If you have not contacted Art Leaders Gallery to arrange payment within 3 days of the time the invoice is sent, we will charge the credit card registered for the auction for the amount of your invoice plus shipping.
Non-Payment: Any buyer that does not make payment will automatically be blocked from future auctions.

Sales Tax: Michigan residents are subject to 6% sales tax. If you are tax-exempt, you can submit your tax-exempt certificate to prevent the collection of tax. Please submit at the time of auction registration. Please see the following for more details.

Failure to Collect Item(s): For collectors who fail to pick up their item(s) within 14 days following the sale, Art Leaders Gallery reserves the right to charge $5 per lot, per day or to deliver said property to a public warehouse for storage at the purchaser's expense. Art Leaders Gallery shall have no liability for any damage to property left on its premises for more than 14 days following the sale. Property which is paid for but left on our premises for any reason for more than 60 calendar days is subject to sale by us with the balance of any funds recovered in excess of storage charges and any other fees being remitted to the buyer.

Online Catalogue: All listings, including reserves, starting prices, and high and low estimates, are subject to change until the auction goes live.

Reserves: This is a no-reserve auction. Any winning bid at or beyond the opening bid will win the lot.

Winning Bid: The highest bidder shall be the Buyer, and if any dispute arises between two or more bidders, the auction coordinator shall decide the Buyer. We are not responsible for any technical issues or bids placed "by mistake".

Purchased Lots: If for any reason a purchased lot cannot be delivered due to any unforeseen circumstances including, but not limited to; damage to an item, theft, misrepresented item, withdrawn consignment, or other such issues in the same condition as at the time of sale, the sale shall be deemed cancelled and Art Leaders Gallery will issue a full refund equal to the purchase price of the item. Art Leaders Gallery shall not be liable for any amount more than that paid by the purchaser.

Withdrawal Prior to Sale: Art Leaders Gallery reserves the right to withdraw any item before the sale and shall have no liability whatsoever for such withdrawal. All starting bids and estimates are subject to change before the start of the auction.

Guarantee Statement: Art Leaders Gallery acts as an agent for various consignors. It exercises care in describing all lots listed and uses judgment in attributing authorship, but offers no guarantee regarding authenticity, condition, or description. The description of the lots in this catalogue may be amended by notice or announcement at sale time. All items in the catalog are sold as described, as is, and all sales are final. Buyer has the right to contact us if the item is not as described. We certify that all information listed is correct to the best of our knowledge. We reserve the right to cancel any sale.

Condition Statement: Art Leaders Gallery is not responsible for the correctness of a statement of any kind concerning any lots listed, whether written or oral, nor for errors or omissions in description or for faults or defects in any lot. Neither the seller, the gallery, or our employees give warranty or guarantee or assume liability in respect of any lot regarding fitness for a particular purpose, description, size, condition, authenticity, medium, or provenance. If a lot does not state the condition, it does not mean that the item is in perfect condition or free from imperfections.

Indemnification: The Buyer agrees to indemnify, defend, and hold harmless Art Leaders Gallery and its employees, agents, affiliates, successors, officers, directors, and assigns, from and against all claims, demands, losses, damages, liabilities, costs, and expenses (including attorney fees) arising out of or relating to any claim or action based upon your use of Online Bidding Services or the breach of this Agreement.

Limitation of Liability: In no event will Art Leaders Gallery be liable for any amount in excess of that paid by the buyer. Governing Law and Jurisdiction: The Conditions of Sale, as well as the buyer's, Consignor's and Art Leaders Gallery respective rights and obligations shall be governed, construed, and enforced in accordance with the laws of the State of Michigan. All persons participating in any auction sale, whether as consignor, bidder, bidder agent, absentee bidder, internet or other means, consent to the exclusive jurisdiction of the state courts located in Oakland County, Michigan.

Severability: If any part of the Conditions of Sale is found by any court to be invalid, illegal, or unenforceable, that part shall be discounted, and the rest of the conditions shall continue to be valid to the fullest extent of the law.
