1) Buyer’s Premium
A 15% Buyer’s Premium will be added to the final bid price.
2) All Sales Final / Condition of Items
All bids are final.
All items are sold “AS IS, WHERE IS” with no warranties or guarantees, expressed or implied, including merchantability or fitness for a particular purpose.
Descriptions are believed to be accurate; however, Henderson Auctions and the seller make no guarantee regarding condition, completeness, or correctness of descriptions.
Inspection prior to bidding is strongly recommended and is available when offered.
3) Payment Terms
Full settlement is due on the day of the auction, or no later than the following business day, unless otherwise stated.
Accepted forms of payment (payable to Henderson Auctions):
Cash
Wire Transfer
Cashier’s Check / Money Order
Personal or Business Check with a bank letter of guarantee
Credit Cards: Visa, MasterCard, Discover, American Express (4% convenience fee applies)
International credit cards are not accepted.
International buyers must pay by wire transfer. A $50 international wire fee applies.
Bank drafts are not accepted.
4) Non-Payment / Late Fees / Collections
Any invoice not paid within five (5) banking days of sale day is subject to interest at 2% per month, prorated daily beginning on sale day.
If payment is not made within the required timeframe, Henderson Auctions may charge the credit card on file for the outstanding balance, including applicable convenience fees and permitted charges.
If a bidder does not pay the balance in full by the scheduled load-out date, the bidder may be subject to being charged in full to the card on file.
5) Sales Tax / Exemptions
Sales tax will be added to all taxable items where applicable and is calculated on the final bid amount plus buyer’s premium when applicable.
Dealers purchasing for resale must provide a valid resale certificate at the time of payment.

Do not rely on financing. You are legally responsible for paying for winning lots regardless of financing approval.
6) Removal / Load-Out / Risk
The buyer is responsible for all freight, handling costs, disassembly, and removal of purchased items.
Items must be removed within the published load-out dates and times (or as stated on the invoice).

Entry onto any auction site is at your own risk. Henderson Auctions is not responsible for injuries or property damage.

B) Non-Firearm Load-Out
Load-out for lots at 13340 Florida Blvd., Livingston, LA 70754:
Monday–Friday, 9:00 AM – 3:30 PM
For lots at other locations, call 225-686-2252 for instructions.
Online / Live Bidding and Auctioneer Authority
The Bid Caller (Auctioneer) has sole discretion to:
Open and close bidding
Determine the final high bidder
Recognize or reject bids, including late bids
Reopen bidding (including for tie bids)
Exclude bidders
Any “winning/outbid” notice from an online platform or third party is not official.
Official notice is only provided by an invoice issued by Henderson Auctions.
Henderson Auctions is not responsible for clerking errors or online platform price discrepancies; the live auctioneer’s call controls.
Venue / Governing Law
Any litigation or disputes, including non-payment or lot-related discrepancies, shall be filed in Livingston Parish, Louisiana, and governed by Louisiana law.
Firearm Terms
Pickup / Transfer Requirements
Local pickup is by appointment and must occur within 15 days of the auction.
A $50 processing fee applies to the invoice only, not per firearm (paid to Henderson Auctions).
Buyers must complete ATF Form 4473 and pass a background check before any firearm is transferred.
If you cannot pass a background check, do not bid.
Denied Background Check / Restocking Fee
If the successful bidder is denied, the firearm may be resold in a future auction and the bidder will be charged a 20% restocking fee to the credit card on file.
Denied bidders may not substitute another person to complete the background check.
Firearm Buyer’s Premium / Taxes / Payment Processing
A 15% Buyer’s Premium applies to firearm lots.
Buyer’s premium is considered part of the purchase price and is subject to sales tax where applicable.
The registered credit card may be charged following the close of the auction, per auction terms.
NFA / Class 3 Firearms
NFA/Class 3 items must be transferred in compliance with federal law.
A $200 federal tax stamp is required per transfer.
Transfers may require ATF Form 4, fingerprint card, and Certificate of Compliance, plus any state/local requirements.
ATF approval may take 120+ days. Buyer remains responsible for payment regardless of timing or state law restrictions.
Binding Contract
NO REFUNDS OR BID CANCELLATIONS.
Online bids are legally binding contracts. Non-performing bidders may be banned and pursued for civil and/or criminal remedies as allowed.
Definitions
Bid Caller: Licensed auctioneer actively calling the auction.
Buyer: Successful high bidder.
Bidder: Any person/entity bidding on a lot.
Owner/Consignor: Party consigning items for auction.
Auctioneer: J.A.H. Enterprises, Inc. d/b/a Henderson Auctions (and affiliates, successors, etc.).
Lot: Any item offered for sale.
Closing: Transfer of ownership/title from owner to buyer.
Frequently Asked Questions
When is payment due?
Payment is due the day of the auction; however, payment is required within three (3) business days after the auction per posted terms.
What is required for tax exemption (Non-Louisiana buyers)?
A copy of your state’s exemption certificate and a completed Louisiana Out-of-State form (R-1079). Email to auctionoffice@hendersonauctions.com or fax to 225-686-0647.
What is required for Louisiana buyers?
A copy of your Louisiana-issued sales tax exemption certificate. Email to auctionoffice@hendersonauctions.com or fax to 225-686-0647.
If a transport company picks up my items, what is required?
A completed bill of lading including buyer number, buyer name, lot numbers, and description of items being hauled. Provide it to the driver and/or email it to auctionoffice@hendersonauctions.com.
What happens if items are not removed on time?
Storage fees may apply (up to $100 per item per day). Items left beyond the removal deadline may be forfeited and/or resold to satisfy storage and handling costs.
