Please take the time to read the following set of terms and conditions for the sale.
1. AGENT: BearCreek Estate & Auction Services and all staff (Company) is acting as agent of the Seller and at no time acting on behalf of the Buyer.
2. BearCreek Estate & Auction Services has full discretion to modify the date and time, order, and details of the sale for any reason or no reason at all, including but not limited to technical issues, emergencies, and convenience of BearCreek Estate & Auction Services or the Seller.
3. PROPERTY CONDITION: All items in this sale are being sold AS IS, WHERE IS without warranty, expressed or implied. ALL SALES ARE FINAL, NO RETURNS/REFUNDS.
4. POSSESSION: Buyer is solely responsible for items purchased at hammer drop and for the safe and timely removal of all items you purchase. BCEAS staff is not available to help with moving, dismantling or loading items. Please bring help to load heavy items.
5. CHECKOUT AND PICKUP: Any items not picked up by the buyer will be considered forfeited and abandoned after 10 days post sale. Anyone entering the sale site is doing so at their own risk. The sellers nor Company/Staff assume any responsibility for your safety during the sale and removal period. Buyers are responsible for dismantling, packing and loading their purchases.
6. PAYMENT, FEES and TAXES: All items must be paid for in full prior to removing from sale site. We accept cash, Cash App, Venmo, credit and debit cards (a 3% convenience fee will be charged for credit/debit card transactions).
• Sales Tax: A 7% Sales Tax will be added to all sales. Sales tax is not assessed at time of purchase for titled vehicles or real esatte.
• Tax ID: If you have a tax ID number, please provide that information to the cashier at registration by filling out or providing NC tax exempt form.
