Our catalog descriptions and estimates reflect the careful judgment of our experts, provided as courtesy to assist our clients in making informed purchases.

Sales Terms
All sales are final.
Items are sold as is, where is, including all faults, imperfections, or errors in description, known or unknown.
MRF is not responsible for authenticity, condition, or description errors, except under the limited 7-day warranty outlined below.
Buyers assume full responsibility for conducting their own due diligence; placing a bid indicates acknowledgement or personal inspection, acceptance of condition, authenticity, provenance, attribution, measurements, documentation, and other material characteristics, and that due diligence has been completed.

Payments
Payment is due immediately after the auction closes.
A Buyer?s Premium of 25% applies to all successful bids.
A 3.5% surcharge applies to electronic payments.
Additional online platforms or processing fees (LiveAuctioneers, PayPal, credit cards, Plaid, Stripe, etc.) are all Buyer?s sole responsibility.
Items must be collected within 5 business days of purchase.
A $50 fee will be assessed for dishonored checks.
Late payments are subject to 1.5% per month interest (18% APR); MRF reserves the right to raise this within legal limits.
Standard state and local sales taxes may apply unless valid exemption documentation is provided.
Buyer is responsible for all collection costs, attorney fees, enforcement fees, court costs, and administration expenses arising from unpaid invoices.
Failure to pay within 3 days permits MRF to automatically charge the card on file used to register for the auction for the full amount of Buyer invoice; cancel the sale; reclaim ownership; restrict access; resell the item; apply resale proceeds to satisfy obligations; pursue legal remedies; restrict future bidding.
No alteration of names or entities will be made to invoices after registration.
Title and ownership of purchased property does not pass to Buyer (or third-party designee) until MRF has received full payment of the hammer price, buyer?s premium, and any associated feeds, in cleared funds.
Until full payment is complete, Buyer holds no legal or equitable title.
Buyer grants MRF a permanent, fully enforceable security interest under UCC in: all purchased property, proceeds from resale of purchased property, any other property or funds of Buyer in MRF?s possession.
MRF may file a UCC-1 Financing Statement or take any necessary legal action to enforce this lien.
Shipping & Insurance
LiveAuctioneers offers partnered shipping with vetted providers to offer buyers convenient domestic and international shipping.
Shipping costs include pickup, packing, shipping, delivery, and insurance.
Buyer is ultimately responsible for all shipping and adequate insurance coverage and costs.
Shipping estimates are based on Buyer-provided zip code, item type, size, weight, and vendor. DIM weight of purchases may be higher than physical weight of items, and may exceed physical weight for shipping calculations.
Final shipping may change based on final Hammer Price and Insured Value.
Single shipping fee may apply for multiple lots; Buyer may choose: LiveAuctioneers shipping, or self-arranged shipping/pickup.
Items are shipped from Frenchtown, New Jersey.
Tracking notifications provided for LiveAuctioneers shipping only, unless otherwise arranged.
MRF assumes no liability for loss, damage, delay, theft, misdelivery, acts, or omissions of purchased lots by any carriers, packers, or shippers, including LiveAuctioneers partners.
Buyer must inspect items immediately upon receipt.
Risk of loss is the sole responsibility of Buyer, including transfers at pickup, item departure from MRF location, or 30 days post sale, whichever is first.
Items of non-pickup may be stored at a rate of $10/day after 30 days from purchase.
Items of non-pickup/arranged shipping are considered abandoned after 90 days post sale.
Limited 7-Day Warranty
All sales are final.
Returns are only allowed under this limited 7-day warranty.
Unauthorized returns are not eligible for refund.
Buyer accepts full responsibility for all return shipping, insurance, and handling costs, as well as risk of transfer during the return period until items have been accepted into MRF?s possession after physical delivery is complete.
Approved remedies are limited to refund of Hammer Price + Buyer?s Premium, minus 20% restocking fee, electronic payment surcharges, shipping and insurance costs, and other administrative fees as applicable.
This limited warranty covers:
Fine Art: Authorship only, verified by a certified, independent expert as approved at the discretion of MRF
Jewelry/Watch/Precious Materials: Metal type, metal fineness within industry standard tolerances, stone identification type
Exclusions: Color descriptions, clarity descriptions, approximate carat weights, cut styles, treatments, inclusions, chips and abrasions, mechanical function, condition, authenticity, provenance, period, historical attribution, other attributions, measurements, documentation, condition, restorations, repairs, or missing components, water resistance, and other material characteristics such as changes in metal color, patina, or oxidation, precious material surface changes such as crazing, fading, cracking, loss from humidity, temperature, sunlight, chemical exposure, inherent defects in settings or mountings, porosity, normal wear, loss, theft, or damage post-sale, shipping errors or mishandling, perceived investment value loss, market value fluctuations, photographic or digital representation inaccuracies, display errors, online platform errors, software failures, any indirect, incidental, special, or consequential damages, and circumstances beyond reasonable control such as force majeure, including war, terrorism, or natural disasters.
All claims require a written report from a qualified, independent, accredited appraiser/laboratory, as approved at the discretion of MRF, and by submission for such claims within 7 days of receipt.
Return requests must be approved in advance, in writing, and will be considered only under this warranty.
Auction Conduct
The highest bid recognized by the auctioneer wins.
MRF reserves the right to:
Refuse registration, bidding, or participation at any time for any reason.
Request identify verification, proof of funds, bank letters, government-issued identification, utility bill, business documents, or beneficial owner information.
Require deposits or pre-authorization holds for any bidder, particularly for lots above $2000.
Withdraw, divide, swap, or combine lots, reject bids, revoke bids, reopen bidding, bid on behalf of sellers, determine winning bids, or void sales at its discretion.
Resolve all disputes; the auctioneer?s decision is final and binding.
Employees, agents, consignors, and affiliated parties may bid.
Hidden reserves may apply.
Bidding acknowledges Buyer due diligence.
Governing Law
All auctions are conducted in Hunterdon County, New Jersey, under New Jersey law
Buyer consents to jurisdiction and venue in Huntercon County, NJ; waives any right to a jury trial.
Indemnification
To the fullest extent permitted by law, Buyer shall indemnify, defend, and hold harmless Madison Rose Finery, its affiliates, officers, directors, employees, agents, consignors, successors, and assigns (collectively, ?MRF Indemnitees?) from and against any and all claims, liabilities, losses, damages, penalties, fines, costs, or expenses, including reasonable attorneys? fees and court costs, arising from or related to:
Any breach or alleged breach by Buyer of these Terms & Conditions;
Buyer?s failure to pay the Purchase Price, Buyer?s Premium, fees, taxes, shipping costs, or any other amounts owed;
Loss, damage, theft, or deterioration of Purchased Property after risk of loss passes to Buyer;
Claims of third parties, including but not limited to claims of ownership, provenance disputes, intellectual property, counterfeiting, or authenticity challenges;
Any acts or omissions of Buyer, Buyer?s agents, or shippers engaged by Buyer in connection with Purchased Property;
Any violation by Buyer of local, state, federal, or international laws or regulations, including customs, export/import, endangered species, and hazardous materials restrictions;
Any unauthorized return, resale, or alteration of Purchased Property.
Arbitration and Dispute Resolution
Agreement to Arbitrate: Buyer and Madison Rose Finery agree that any and all disputes, claims, controversies, or causes of action arising out of or relating to:
The auction or sale of any lot,
Buyer?s obligations or conduct,
The interpretation, enforcement, or breach of these Terms & Conditions, shall be finally resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, or any successor arbitration body agreed upon by the parties.
Location and Law: Arbitration shall be conducted in Hunterdon County, New Jersey, and shall be governed by the laws of the State of New Jersey, without regard to conflicts-of-law principles.
Arbitrator Authority
The arbitrator(s) shall have exclusive authority to determine the scope and enforceability of this arbitration agreement, including any claims of unconscionability, waiver, or jurisdiction.
Finality and Enforcement
The arbitrator?s award shall be final, binding, and enforceable in any court of competent jurisdiction. Judgment on the award may be entered in any court having jurisdiction.
Costs
Unless otherwise directed by the arbitrator, each party shall bear its own attorneys? fees, costs, and expenses associated with the arbitration, in addition to their share of the arbitrator?s and administrative fees. Madison Rose Finery reserves the right to recover attorneys? fees, costs, and expenses from Buyer as provided under the Indemnification clause or applicable law.
Preclusion of Class Actions
Buyer expressly waives the right to arbitrate disputes as a class, collective, or representative action. Arbitration must proceed solely on an individual basis.
Definitions of Terms
For purposes of these Terms & Conditions, the following definitions apply:
?MRF? or ?Madison Rose Finery?
Refers to Madison Rose Finery, its owners, officers, directors, employees, agents, affiliates, representatives, and consignors.
?Buyer,? ?you,? or ?your?
The individual or entity registering, bidding, or purchasing in any sale, whether directly or through an agent or third-party platform.
?Bidder?
Any person or entity registered to participate in an auction. By bidding, the Bidder agrees to all Terms & Conditions.
?Auction?
Any live, online, timed, hybrid, absentee, private, or third-party?facilitated sale conducted by MRF.
?Auctioneer?
The person designated by MRF to conduct the Auction, determine winning bids, exercise discretion, and resolve bidding disputes.
?Lot,? ?Property,? or ?Purchased Property?
Any item or group of items offered or sold by MRF, including jewelry, watches, fine art, antiques, decorative arts, or other assets.
?Hammer Price?
The final bid accepted by the Auctioneer at close of bidding, exclusive of Buyer?s Premium, taxes, or fees.
?Buyer?s Premium?
The mandatory fee added to the Hammer Price as compensation to MRF, as disclosed in the catalog or invoice.
?Purchase Price?
The total amount owed by the Buyer, including:
Hammer Price;
Buyer?s Premium;
Sales tax (if applicable);
Surcharges, processing fees, storage, administrative fees;
Shipping, insurance, and handling charges;
Any platform or third-party fees.
?Bid?
Any offer made in person, online, by phone, absentee, or through automated or third-party bidding systems.
?Successful Bidder? / ?Buyer?
The Bidder recognized by the Auctioneer as having placed the highest valid Bid.
?Sale Date?
The calendar date on which a Lot is offered for sale.
?Payment Due Date?
The date specified by MRF by which the Purchase Price must be paid in full.
?Risk of Loss?
The point at which responsibility for loss, theft, damage, or deterioration transfers to the Buyer?typically upon pickup, release to Buyer?s agent or shipper, or the 30th day after the Sale Date, unless otherwise stated.
?Title? or ?Ownership?
Legal rights to a Lot. Title transfers only after MRF receives full, cleared payment of the Purchase Price.
?Security Interest?
MRF?s lien or legally enforceable claim over purchased Property to secure payment, including the right to file a UCC-1 Financing Statement.
?UCC?
The Uniform Commercial Code as adopted by the State of New Jersey.
?UCC-1 Financing Statement?
A filing used to perfect MRF?s Security Interest in Property.
?Third-Party Platforms? / ?Third-Party Fees?
Platforms or payment networks used to facilitate bidding or transactions (e.g., LiveAuctioneers, Invaluable, Stripe, PayPal, Plaid). All associated fees are the Buyer?s responsibility.
?Shipping Partner? / ?LiveAuctioneers Shipping?
Third-party packers or carriers responsible for shipping, insurance, or delivery of purchased Property. Buyer bears all related costs and risks.
?Business Days?
Monday through Friday, excluding federal and New Jersey state holidays.
?Warranty Period?
The seven (7) calendar days following Buyer?s receipt of the Property, during which the Limited Warranty may apply.
?Limited Warranty?
A narrow, express warranty on specific attributes (e.g., metal fineness, gemstone type, approximate carat weight, authorship), as outlined by MRF. All other warranties are excluded.
?Material Discrepancy?
A significant factual error in a catalog description or listing affecting a Lot?s identity, composition, or characteristics.
?Condition Report? / ?Catalog Description?
MRF?s statements regarding a Lot?s characteristics, age, attribution, provenance, or condition. All such statements are opinion unless expressly covered by the Limited Warranty.
?Independent Expert? / ?Qualified Appraiser or Laboratory?
A recognized authority accredited by reputable organizations whose written report may be required for warranty claims, solely at MRF?s discretion.
?Restocking Fee?
A percentage-based fee charged on approved returns relating to a Limited Warranty or Material Discrepancy.
?Abandoned Property?
Any Lot not picked up, shipped, or claimed within the required timeframe (e.g., 90 days), deemed forfeited with no refund due. MRF may resell, retain, donate, or discard such Property.
?Force Majeure? / ?Acts Beyond Control?
Events outside MRF?s reasonable control?such as natural disasters, war, terrorism, labor disputes, pandemics, or government action?which relieve MRF of liability for delays or failures in performance.
?Third-Party Claim?
Any legal or equitable claim by another party that may affect title to the Property.
?Total Loss?
Complete destruction or irretrievable loss of a Lot while under MRF?s responsibility. Remedies are limited to Hammer Price + Buyer?s Premium.
?Partial Loss / Damage?
Damage or loss not amounting to Total Loss. Remedies may include depreciation or approved repair costs at MRF?s discretion.
?Withdrawal / Cancelation?
MRF?s right to remove a Lot, void a sale, combine/divide Lots, or reject Bids at any time.
?Buyer?s Acknowledgement? / ?Acceptance of Terms?
Bidding or purchase constitutes full acceptance of all terms, conditions, disclaimers, warranties, shipping policies, and legal protections in this document, without modification.

Legal rights to a Lot. Title transfers only after MRF receives full, cleared payment of the Purchase Price.
?Security Interest?
MRF?s lien or legally enforceable claim over purchased Property to secure payment, including the right to file a UCC-1 Financing Statement.
?UCC?
The Uniform Commercial Code as adopted by the State of New Jersey.
?UCC-1 Financing Statement?
A filing used to perfect MRF?s Security Interest in Property.
?Third-Party Platforms? / ?Third-Party Fees?
Platforms or payment networks used to facilitate bidding or transactions (e.g., LiveAuctioneers, Invaluable, Stripe, PayPal, Plaid). All associated fees are the Buyer?s responsibility.
?Shipping Partner? / ?LiveAuctioneers Shipping?
Third-party packers or carriers responsible for shipping, insurance, or delivery of purchased Property. Buyer bears all related costs and risks.
?Business Days?
Monday through Friday, excluding federal and New Jersey state holidays.
?Warranty Period?
The seven (7) calendar days following Buyer?s receipt of the Property, during which the Limited Warranty may apply.
?Limited Warranty?
A narrow, express warranty on specific attributes (e.g., metal fineness, gemstone type, approximate carat weight, authorship), as outlined by MRF. All other warranties are excluded.
?Material Discrepancy?
A significant factual error in a catalog description or listing affecting a Lot?s identity, composition, or characteristics.
?Condition Report? / ?Catalog Description?
MRF?s statements regarding a Lot?s characteristics, age, attribution, provenance, or condition. All such statements are opinion unless expressly covered by the Limited Warranty.
?Independent Expert? / ?Qualified Appraiser or Laboratory?
A recognized authority accredited by reputable organizations whose written report may be required for warranty claims, solely at MRF?s discretion.
?Restocking Fee?
A percentage-based fee charged on approved returns relating to a Limited Warranty or Material Discrepancy.
?Abandoned Property?
Any Lot not picked up, shipped, or claimed within the required timeframe (e.g., 90 days), deemed forfeited with no refund due. MRF may resell, retain, donate, or discard such Property.
?Force Majeure? / ?Acts Beyond Control?
Events outside MRF?s reasonable control?such as natural disasters, war, terrorism, labor disputes, pandemics, or government action?which relieve MRF of liability for delays or failures in performance.
?Third-Party Claim?
Any legal or equitable claim by another party that may affect title to the Property.
?Total Loss?
Complete destruction or irretrievable loss of a Lot while under MRF?s responsibility. Remedies are limited to Hammer Price + Buyer?s Premium.
?Partial Loss / Damage?
Damage or loss not amounting to Total Loss. Remedies may include depreciation or approved repair costs at MRF?s discretion.
?Withdrawal / Cancelation?
MRF?s right to remove a Lot, void a sale, combine/divide Lots, or reject Bids at any time.
?Buyer?s Acknowledgement? / ?Acceptance of Terms?
Bidding or purchase constitutes full acceptance of all terms, conditions, disclaimers, warranties, shipping policies, and legal protections in this document, without modification.
