It is each bidder's responsibility to judge the condition of an auction item. Bidders are encouraged to contact us by email with any condition questions, and to review the condition, description and photos carefully. All sales are final, especially in the case of "parts" lots which are sold as is.

No implied or written warranty on any items and American Antique Auctions will not assume any responsibility or liability with respect to age, condition, rarity, provenance or historical relevance of the items being sold. Unless stated, assume battery operated toys do not work.
BIDDING: The Auctioneer will be the final judge as to which bidder is the highest bidder. In the event of any dispute in this matter, the auctioneer shall at his discretion decide to reopen the bidding or not. Auctioneer is not responsible for technological or internet bid delays.

TELEPHONE BIDS: Under limited circumstances, telephone bids may be accepted if the bidder has been approved 24 hours prior to the auction. Auction house is not responsible for telephone dropped calls or other communication malfunctions.

BID REJECTIONS/WITHDRAWAL OF LOTS: American Antique Auctions reserves the right to reject any and all bids from any bidder or potential bidder at any time without restrictions. American Antique Auctions also reserves the right to withdraw any lot at any time prior to the end of the auction and assumes no liability for such withdrawal.
BID FAILURES, ERRORS AND OMISSIONS: All absentee bids will be executed as a convenience to bidders, but American Antique Auctions will not be responsible for any failures, errors, or omissions related to the execution of any bids, including any related computer/internet problems or lagging. All bids must be submitted consistent with the terms of the auction and the bidding instructions.
BUYER PREMIUMS/CHARGES: Online auction premium 25%. Credit card fee through LivePayments.
HIGH BIDDERS/INVOICES: Invoices will be emailed to successful bidders following the auction. Payment by LiveAuctioneers CC. Full payment is due within 3 days of receiving the invoice.
State sales tax will be charged where laws deem appropriate unless a valid tax exemption or resale certificate number is provided---You Must File this with Live Auctioneers! You are responsible for resale form completion online. We cannot edit this!

Bidders with invoices overdue by 10 days or longer will also permanently lose bidding privileges with American Antique Auctions and the entire auction bidding platform. Items may be sold any time after 14 days. Storage fees at $20 a day after 21 days.
Buyer Pays Shipping Cost determined by discount shipping partner. Shipping instructions are on the invoice!! Items must be picked up or shipped within 14 days. Items not picked up after 30 days are surrendered.
Should an item be damaged in shipment, insurance claims would be made directly with the Shipper. ALL packaging must be saved. American Antique Auctions will assist successful bidders in making an insurance claim if an item is properly insured and damaged in shipping. However, American Antique Auctions does not accept, and disclaims, any responsibility or liability for any shipping or mailing or shipping related damage.
