1. Acceptance of Terms

By accessing this website, registering for updates, or attending any advertised estate sale, you (“User” or “Attendee”) agree to be bound by these Terms & Conditions and Liability Waiver.

If you do not agree, please do not use this website or attend our sales.

2. Website Use
All content (photos, descriptions, pricing) is provided for informational purposes only and may be updated or changed without notice.
We do not guarantee the availability of any listed item.
Unauthorized use, copying, or distribution of website content is prohibited.

3. Sale Terms
All items are sold “as is,” “where is,” and with all faults.
All sales are final — no refunds, returns, or exchanges.
Prices may change at any time without notice.
Items are sold on a first-come, first-served basis unless otherwise stated.

4. Payments
Accepted payment methods are Cash, Venmo or Zelle.
Full payment is required at the time of purchase.
No item may be removed without payment in full.

5. Item Descriptions & Condition
We strive for accuracy but do not guarantee descriptions, authenticity, or condition.
Photos may not fully represent the current condition of items.
Users are responsible for inspecting items in person before purchase.

6. Pickup & Removal
Buyers are responsible for the safe removal of purchased items.
Removal must occur within the designated sale timeframe.
We are not responsible for accidents, damage, or injuries during item removal.

7. Conduct at Estate Sales
By attending this sale, you agree to:
Follow all posted rules and staff instructions
Supervise children at all times
Respect restricted areas and private property
Comply with any bag or entry restrictions

We reserve the right to refuse entry or service to anyone at our discretion.

8. Assumption of Risk
Estate sale locations are private properties and may present hazards, including but not limited to:
Stairs, uneven floors, or narrow walkways
Heavy or fragile objects
Limited space or crowded conditions

By attending, you voluntarily assume all risks associated with entering and moving about the premises.

9. Liability Waiver
To the fullest extent permitted by law, you agree to release and hold harmless property owners, employees, and agents from any and all claims, including but not limited to:
Personal injury or accidents
Property damage
Loss or theft of personal belongings
Any damages arising from participation in or attendance at an estate sale

This includes claims based on negligence, except where prohibited by law.

10. Damage Responsibility
You agree to be financially responsible for any damage you cause to property, items, or the premises.

11. Security & Monitoring
Sales locations may use video surveillance.
Theft or misconduct may result in removal and potential legal action.

12. Privacy
Any personal information collected through the website (e.g., email signups) will be used in accordance with our Privacy Policy.
We do not sell or share your personal information without consent, except as required by law.

13. New York Legal Compliance
For sales conducted in the State of New York:
Limitation of Liability: Certain liability waivers may be limited under New York law. Nothing in these Terms is intended to waive liability where such waiver is prohibited, including for gross negligence or willful misconduct.
General Obligations Law § 5-326: To the extent applicable, any waiver of liability for negligence may be deemed void if an admission fee is charged for entry. These Terms shall be interpreted accordingly.
Consumer Protection: These Terms comply with applicable New York consumer protection laws, including prohibitions against deceptive business practices under New York General Business Law § 349.
Sales Tax: Applicable New York State and local sales taxes will be collected where required by law.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York.
Venue: Any disputes shall be resolved in the courts located within the State of New York.

14. Changes to Terms
We reserve the right to update or modify these Terms & Conditions at any time. Continued use of the website or attendance at sales constitutes acceptance of any changes.
