TERMS:
All lots are sold AS IS, WHERE IS and without recourse of any kind. Prospective buyers are strongly advised to examine personally any property in which they are interested, before the auction takes place, to determine its condition, size, and whether or not it has been repaired or restored. Kotler's nor its consignor makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalog or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging; nor does a reference to particular defects imply the absence of others.
RESERVE: Some lots are offered subject to a reserve. A reserve is a confidential minimum price below which such a lot will not be sold.
RECORD OF SALE: The record of sale, kept by the auctioneer and clerk, will be taken as absolute and final in all disputes.
START TIME:
Auction will start promptly at 12 Noon EST (New York Time). We strongly suggest that if you want to ensure participation you leave a left bid to lessen the chance of missing an item during the live sale.
BUYERS PREMIUM:
A buyer's premium of 27.5% of the hammer price shall be added to each purchase up to $15,000, 25% from $15,000 - $30,000 and 22% from $30,000 and up to reach the total sales price.
TAX: The total sales price is subject to applicable sales tax. NY residents will pay 8.625% unless a (tax exempt) resale certificate is on file with the auction house.
PAYMENT:
Credit Card, Cash, Wire Transfer, Venmo, Zelle, CashApp and PayPal.
INTERNATIONAL BUYERS: Must issue a wire transfer in US funds only. NO exceptions.
CREDIT CARD, PAYPAL & WIRE TRANSFER TERMS:
Domestic invoices less than $500 can be funded via credit card, paypal, zelle, venmo, or cashapp. All international transactions must be funded with
a bank wire transfer. All domestic transactions greater than $2000.00 must be issued via bank wire transfer.
WIRE INSTRUCTIONS: Kotler Galleries & Auctioneers will email (our bank wire info) to winning bidders within 24 hours post sale.
BIDDING: The highest bidder shall be the buyer and if any dispute arises between two or more bidders, the auctioneer will decide the buyer or immediately put the item up for sale again. In the event of a tie between an online bidder and a floor bidder, the floor bid will take precedence. The auctioneer's decision will be binding and final.
TELEPHONE BIDDING:
Phone bidding is not an available service. Only absentee bids will be accepted.
AUCTION INQUIRIES:
All auction inquiries should be received 24 hours prior to the start of the auction.
PACKING & SHIPPING:
Buyer's are responsible for all packing, shipping and insurance charges. Packing is handled by Kotler's in house shipping center or its authorized agents.
