AUCTION TERMS & CONDITIONS

These Auction Terms & Conditions (“Terms”) govern participation in any auction, estate sale, consignment sale, or related service conducted by MWM Estate Sales (“Company,” “Auction Company,” “we,” “our,” or “us”). By registering, bidding, purchasing, consigning items, or participating in any sale, all bidders and buyers agree to these Terms in full.



1. REGISTRATION

All bidders must:

Be at least 18 years of age
Provide accurate registration information
Provide valid payment information when required
Agree to all auction terms prior to bidding
The Company reserves the right to:

Refuse registration to any individual
Suspend or revoke bidding privileges
Cancel accounts suspected of fraud, abuse, or nonpayment


2. AUCTION FORMAT

Auctions may be conducted:

Online
In-person
Timed online
Live webcast
Hybrid format
The Company reserves the right to:

Add or remove items
Split or combine lots
Modify auction dates or closing times
Cancel any sale or lot at its sole discretion


3. ITEM DESCRIPTIONS & CONDITION

All property is sold:

“AS IS, WHERE IS, WITH ALL FAULTS.”

Descriptions, photographs, measurements, and condition reports are provided as a courtesy only and are believed to be accurate to the best of our knowledge, but are not guaranteed.

The Company makes:

No warranties
No guarantees
No representations regarding:
Authenticity
Age
Origin
Condition
Completeness
Functionality
Merchantability
Fitness for a particular purpose
Bidders are solely responsible for:

Inspecting items
Determining condition and value
Verifying dimensions and descriptions before bidding
Failure to inspect does not negate the sale.



4. BIDDING

By placing a bid, the bidder enters into a legally binding contract to purchase the item if declared the winning bidder.

Bids:

Cannot be retracted once submitted
May be subject to reserve pricing
May be incrementally advanced by the auction platform
The Company reserves the right to:

Reject bids
Resolve bidding disputes
Reopen bidding in the event of technical issues or disputes
Determine the final winning bidder at its sole discretion
In the event of identical bids, precedence may be given to the first bid received.



5. BUYER’S PREMIUM

A buyer’s premium may be added to the final hammer price.

Applicable taxes, fees, shipping charges, and processing fees may also apply.

All charges will be disclosed before invoice payment when possible.



6. PAYMENT TERMS

Accepted payment methods may include:

Credit cards
Debit cards
Cash
Certified funds
Electronic payment methods
Payment is due:

Immediately upon auction close unless otherwise stated
Failure to make timely payment may result in:

Bid cancellation
Account suspension
Forfeiture of future bidding privileges
Collection actions
Legal remedies
The Company reserves the right to charge the payment method on file.

Returned checks are subject to additional fees.



7. SALES TAX

Applicable sales tax will be collected in accordance with New York State law unless the buyer provides valid tax exemption documentation before payment.

Buyers are responsible for complying with all tax laws applicable to their purchases.



8. PICKUP & REMOVAL

Buyers are responsible for:

Removing all purchased items during scheduled pickup times
Bringing appropriate labor, tools, packing materials, and transportation
The Company and property owners are not responsible for:

Loading assistance
Accidents or injuries during removal
Damage occurring after the sale
Items not removed within the stated pickup period may:

Be considered abandoned
Be forfeited without refund
Incur storage fees
Be resold at the Company’s discretion
No refunds will be issued for abandoned items.



9. SHIPPING

Shipping may be offered on select items at the Company’s discretion.

Buyers are responsible for:

Shipping costs
Insurance
Packaging materials
Carrier fees
The Company is not liable for:

Shipping delays
Carrier damage
Lost packages
Risk of loss transfers to the buyer once items are released to a carrier.



10. DEFAULT & NONPAYMENT

If a buyer fails to pay or otherwise breaches these Terms, the Company may:

Cancel the sale
Retain partial or full payment as liquidated damages
Resell the item
Pursue legal remedies
Report the account to auction platforms or collection agencies
The defaulting bidder remains liable for:

Any deficiency
Collection costs
Attorney fees
Administrative expenses


11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company, its owners, employees, agents, consignors, affiliates, and property owners shall not be liable for:

Personal injury
Property damage
Theft
Technical failures
Website interruptions
Inaccuracies in listings
Missed bids
Loss of profits
Consequential or incidental damages
Participation in auctions and property access is entirely at the participant’s own risk.



12. INDEMNIFICATION

Buyers and bidders agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, liabilities, losses, costs, or expenses arising from:

Participation in the auction
Breach of these Terms
Removal or transportation of purchased items


13. RIGHT TO REFUSE SERVICE

The Company reserves the right to:

Refuse service to anyone
Remove individuals from auction premises
Deny future participation for any reason deemed appropriate


14. DISPUTES & GOVERNING LAW

These Terms shall be governed by the laws of the State of New York.

Any disputes arising from auction participation shall be resolved in the courts located in New York State.

Participants agree to submit to the jurisdiction of those courts.



15. PRIVACY

Participant information may be collected and used in accordance with the Company’s Privacy Policy.

Information may be shared with:

Auction platforms
Payment processors
Legal authorities when required by law
The Company does not sell personal information.



16. TECHNOLOGY FAILURES

The Company is not responsible for:

Internet outages
Platform failures
Software malfunctions
Delayed bids
Technical interruptions
The Company reserves the right to:

Extend bidding
Reopen bidding
Cancel affected lots
Resolve disputes resulting from technical issues


17. FIREARMS, RESTRICTED ITEMS & PROHIBITED PROPERTY

The Company reserves the right to refuse the sale of:

Illegal items
Hazardous materials
Recalled products
Restricted weapons
Counterfeit goods
Property prohibited by law
Buyers are solely responsible for ensuring lawful ownership and transportation of purchased property.



18. CONSIGNOR TERMS

Consignors warrant they:

Legally own consigned property or have authority to sell it
Are transferring property free of liens or claims
Have accurately disclosed known defects or issues
The Company reserves sole discretion regarding:

Lotting
Pricing
Advertising
Marketing
Sale format
Unsold items may:

Be returned
Donated
Disposed of
Relisted
as determined by the Company and consignor agreement.



19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties regarding auction participation and supersede prior verbal or written agreements unless otherwise agreed in writing.

If any provision is deemed unenforceable, the remaining provisions shall remain in effect.
