ACME Auctions Terms & Conditions
By registering and bidding, all participants agree to these Terms & Conditions. These terms govern the auction in full, superseding all prior announcements, advertisements, and published materials.
1. Bidding & Registration:
Bidders must register with valid ID and credit card to participate. The Auctioneer reserves the right to deny registration or reject any bid deemed not commensurate with an item?s value.
2. Buyer?s Premium & Payment:
A 25% buyer?s premium plus applicable sales tax applies to all purchases. Payments are processed through LiveAuctioneers and charged to the card on file within 24 hours post-auction. Full payment is required within 5 business days. Failure to pay may result in sale cancellation, financial liability, and disputes filed with LiveAuctioneers.
3. Shipping & Combined Invoices:
All shipping is handled in-house. Multiple lots will be combined for cost-effective shipping. Please await a revised invoice before submitting payment. Customs declarations reflect full sales price. Insurance is available at buyer?s request. International buyers are responsible for customs, taxes, and duties.
4. Descriptions & Condition Reports:
Catalog descriptions are guides only. Absence of condition notes does not imply an item is free of defects. All items are sold ?AS IS, WHERE IS.? Additional condition reports are available upon request up to two days prior to auction. All sales are final.
5. Estimates & Reserves:
Pre-sale estimates are for reference and do not predict final sale price. Some lots are subject to confidential reserves.
6. Auctioneer Authority:
Auctioneer has sole discretion over bid acceptance, lot withdrawal, bidding increments, and pace of sale. Proxy bidding up to reserve is permitted.
7. Internet & Absentee Bidding:
Online bidding is offered as a convenience. ACME Auctions is not responsible for technical failures. In combined live/online auctions, floor bids take precedence over internet bids.
8. Ownership & Risk of Loss:
Ownership and risk transfer to the buyer at the fall of the hammer. Buyers are responsible for the security and transport of their purchases.
9. Returns & Limited Guarantee:
All lots are sold without warranty. Returns are only accepted if (a) the physical condition materially differs from the catalog description, (b) a condition report was requested and provided prior to bidding, and (c) the buyer notifies ACME within 24 hours of receipt. Items must be returned within 10 days in original condition. Shipping is non-refundable.
10. Sales Tax:
Applicable New York State sales tax will be applied unless a valid resale certificate is provided. Out-of-state buyers are exempt unless opting for local pickup.
11. Legal Disputes:
Any disputes arising from the auction will be resolved through binding arbitration in Suffolk County, New York. The prevailing party may recover attorney?s fees and collection costs. Non-payment subjects the buyer to additional fees, interest, and legal action.
12. Liability:
ACME Auctions is not liable for damage or loss of items post-sale or for assisting with transport. Items not removed within 12 days may be considered abandoned.
13. Acceptance of Terms:
Placing a bid signifies full acceptance of these terms. Terms may only be modified by written agreement with ACME Auctions.
