AUTHENTIQUE LUX

CONDITIONS OF SALE

Participation in this auction constitutes the bidder?s acknowledgement that they have read, understood, and agreed to these Conditions of Sale. By placing a bid through LiveAuctioneers or any other bidding platform, the bidder enters into a legally binding agreement with Authentique Lux.

1. ACCEPTANCE OF TERMS

By registering to bid or placing any bid, whether in person, online, absentee, telephone, or otherwise, the bidder agrees to be bound by these Conditions of Sale together with any additional terms published by LiveAuctioneers.

Failure to read these Conditions does not relieve any bidder of their contractual obligations.



2. BINDING CONTRACT

Each successful bid constitutes a legally enforceable contract.

Winning bidders are obligated to complete the purchase.

Failure to pay constitutes breach of contract and may result in:

? Cancellation of bidding privileges

? Reporting to LiveAuctioneers

? Collection efforts

? Legal action

? Recovery of attorney?s fees and collection costs where permitted by law



3. BUYER?S PREMIUM

A 15% Buyer?s Premium will be added to the final hammer price.

The Purchase Price equals:

Hammer Price

plus

15% Buyers Premium

plus

Applicable Sales Tax

plus

Shipping, Insurance and Handling (if applicable)



4. PAYMENT TERMS

Payment is due within seventy-two (72) hours following the auction unless otherwise agreed in writing by Authentique Lux.

Accepted payment methods may include:

? LiveAuctioneers Payments

? Wire Transfer

? ACH

? Approved Credit Cards

? Other payment methods approved by Authentique Lux

Auth?ntique Lux reserves the right to require wire transfer for:

? International purchases

? High-value purchases

? First-time buyers

? Any transaction deemed high-risk.



5. TITLE AND RISK OF LOSS

Ownership shall not transfer until Authentique Lux has received cleared funds in full.

Risk of loss transfers to the buyer once the property has been delivered to the shipping carrier or released to the buyer or the buyer?s designated representative.



6. ALL SALES ARE FINAL

ALL SALES ARE FINAL.

Every lot is sold:

AS IS

WHERE IS

WITH ALL FAULTS

No refunds.

No exchanges.

No returns.

No cancellations.

No price adjustments.

No buyers remorse claims.

No exceptions except where expressly required by applicable law.



7. CONDITION OF PROPERTY

Condition reports are provided solely as a courtesy.

Descriptions represent opinions and are not guarantees.

Normal wear consistent with age and prior use should be expected.

Photographs are part of the description but may not reveal every imperfection.

Bidders are solely responsible for determining condition before bidding.

Failure to inspect a lot does not invalidate the sale.



8. AUTHENTICITY

Authentique Lux guarantees that items are described in good faith based upon our professional knowledge and authentication procedures.

Minor errors or differing expert opinions do not constitute grounds for rescission.

Vintage items may contain repairs, replacements, restorations, polishing, resizing, servicing, aftermarket components, or normal wear.

Buyers acknowledge that authentication involves expert opinion and reasonable judgment.



9. WATCHES

Mechanical watches are sold based upon cosmetic and observable condition only.

No warranty is made regarding:

? Timekeeping

? Water resistance

? Future servicing

? Accuracy

? Internal movement condition

Service history may be unknown unless specifically stated.



10. JEWELRY

Gemstone weights, metal weights, measurements, clarity, color, and grading are approximate unless accompanied by an independent laboratory report specifically identified in the description.



11. HANDBAGS & LUXURY GOODS

Luxury handbags and accessories may exhibit normal signs of prior ownership.

Descriptions reflect our opinion after inspection.

Original boxes, dust bags, authenticity cards, receipts, or accessories are included only when specifically stated.



12. RESERVES

Some lots may be offered subject to confidential reserve prices.

The auctioneer may execute bids on behalf of the consignor up to the reserve in accordance with applicable law.



13. AUCTIONEER?S DISCRETION

Authentique Lux reserves the absolute right to:

? Reject any bid

? Refuse any bidder

? Withdraw any lot

? Re-offer any lot

? Resolve bidding disputes

? Reopen bidding

? Cancel any sale resulting from clerical, technological, payment, or catalog errors

The auctioneer?s decision shall be final.



14. TECHNOLOGY FAILURES

Authentique Lux shall not be responsible for:

Internet interruptions

Platform outages

Power failures

Software errors

Transmission delays

Bid transmission failures

LiveAuctioneers system interruptions

Absentee bid failures

Telephone bid failures

or any other technological issue beyond our reasonable control.



15. SHIPPING

Shipping is available at the buyer?s expense.

Shipping charges include:

Packaging

Insurance

Carrier fees

Handling

Buyers are responsible for providing accurate shipping information.

Authentique Lux is not responsible for delays caused by carriers, customs authorities, weather, governmental agencies, or force majeure events.



16. INTERNATIONAL BUYERS

International buyers are solely responsible for:

Import duties

VAT

Customs fees

Brokerage fees

Import restrictions

Licensing requirements

Any seizure by customs authorities.



17. STORAGE

Purchased property not collected within a reasonable period may incur storage fees.

Items left beyond ninety (90) days may be deemed abandoned to the fullest extent permitted by law, and Authentique Lux reserves the right to resell such property to recover outstanding amounts, storage, and associated costs.



18. CHARGEBACKS

Initiating a chargeback or payment dispute after receiving purchased property does not cancel the buyers contractual obligations.

Authentique Lux reserves the right to:

Pursue collection

Recover attorney?s fees where permitted

Recover court costs where permitted

Recover shipping costs

Recover payment processing fees where permitted

Report fraudulent disputes to payment processors and appropriate authorities.



19. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Authentique Lux shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising out of the purchase or use of any property.

Any liability shall not exceed the hammer price actually paid for the applicable lot.



20. PRIVACY

Buyer information will be handled in accordance with applicable privacy laws and used solely for auction administration, payment processing, shipping, fraud prevention, customer service, and legal compliance.



21. FORCE MAJEURE

Authentique Lux shall not be liable for delays or inability to perform caused by circumstances beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, pandemics, governmental action, transportation interruptions, cyberattacks, or utility failures.



22. GOVERNING LAW

These Conditions of Sale shall be governed by the laws of the State of Texas without regard to conflict of law principles.

Venue for any dispute shall lie exclusively in the state or federal courts located in Bexar County, Texas, unless applicable law requires otherwise.



23. SEVERABILITY

If any provision of these Conditions of Sale is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.



24. ENTIRE AGREEMENT

These Conditions of Sale, together with the auction catalog and any written announcements made by Authentique Lux, constitute the complete agreement between the parties concerning the sale.



25. ACCEPTANCE

By registering to bid or placing any bid, the bidder acknowledges that they have read, understood, and agreed to these Conditions of Sale and accepts full responsibility for all purchases made.
