TERMS AND CONDITIONS FOR A LIVE SALE

ALL SALES ARE FINAL. NO REFUNDS. ALL PROPERTY SOLD “AS IS, WHERE IS”. BUYER’S RESPONSIBILITY:
FOR ONLINE AUCTION ONLY - ANY WINNING BID OVER $500 WILL BE REQUIRED TO PAY VIA WIRE TRANSFER. TRANSFER INSTRUCTIONS WILL BE INCLUDED WITH YOUR INVOICE.
• We accept cash and credit cards. We charge 3% for every charge card transaction to cover the bank fees associated with the charge.

• Item Condition: It is the Buyer’s responsibility to determine the condition and usefulness of items being purchased. If you have questions about the condition of a item, please feel free to talk with one of our crew members for more information. We will answer any questions to the best of our ability.

• On the pickup day, you will be required to take all items with you. We will not hold any item past the last day of the live sale. Some pickup locations are at a private residence (estate sales). Pickup times must be held firm at these locations. We want to extend a courtesy to the homeowner by completing the sale and pickup in a timely manner. If you purchased a lot of multiple items, you must take ALL items whether you want all items or not.

Come prepared to pick up. Please bring your own help to load large items. Also bring boxes, bags or any other packing material needed for you to obtain your items. If you are unable to take your paid items during the posted sale times, please contact our office for further options.

If the above conditions are not complied with and items have not been picked up at the pre-arranged time, the auction house has other remedies available to them and the seller. The auction house at our option may 1) resell the property publicly or privately. 2) cancel the sale, retaining all liquidated damages on all payments made by the purchaser. All other incidental damages will be charged. Auction House is acting as an agent and agent only and is not responsible for the acts of his or her principals.

All persons attending the pickup process of sold goods assume all risks of damage of items or loss to persons and; specifically release the auction house, all employees, real property owners and consignors from any and all liability. Neither auction house or its principals and/or consignors or property owners shall be held liable by reason of any defect in or condition of the premises on which the sale and pickup is held including but not limited to personal injury, fire or theft.

• FOR ONLINE AUCTIONS ONLY: Pickup Times/Location: Pickup times and location will be published on the paid invoice. All items must be picked up during this time period. If, however, there are extenuating circumstances that you are unable to pick up items during the posted pickup time, please contact us IMMEDIATELY so that other arrangements can be made. WE WILL NOT STORE ANY ITEMS DUE TO FAILURE TO PICKUP. THERE IS NO GUARANTEE THAT YOUR ITEM WILL BE HERE IF YOU FAIL TO PICK UP DURING THE REGULARLY SCHEDULED PICKUP TIME. If you fail to pick up during the posted pickup times and other arrangements have not been made, we will charge you for storage until such time as we decide that we should resell the items and you will forfeited any costs already paid. We also reserve the right to charge a disposal fee of $100 if any items are left behind or not picked up.

• Indemnification: Buyer shall indemnify Amplify Auctions, LLC against any claims, damages, or liability (including reasonable attorney’s fees) as a result of an injury or other harm suffered by any person and stemming from the sale, whether arising before, during or after the sale. Buyer agrees to indemnify Amplify Auctions, LLC for any damages or losses. Buyer will not hold Amplify Auctions, LLC, its owners/managers, individual property owners, affiliates or its employees, liable for accidents, injury, theft, or incidents related to this purchase.

• Authenticity: Item descriptions are believed to be correct. Neither auction house or seller makes any warranties of any kind with respect to the property. In no event shall the auction house or seller be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source origin, fitness for a particular purpose, condition, etc.

• The Auction: The Auction House owner, employees and consignors reserve the right to purchase any items in the sale.

• Governing Law: The laws of the State of Texas govern this agreement. Any and all lawsuits must be filed in Van Zandt County courts and the Northern District of Texas. Privacy Policy included in these terms and conditions is the privacy policy as outlined on the Amplify Auctions’ website.

Buyers agree that by signing up as a buyer, you agree and give permission for Amplify Auctions, LLC and it's affiliates to use your email address to send you promotional material regarding current and/or future auctions.
