L&S General Store L.L.C. – Online Auction Terms & Conditions

1. Items Sold "As Is" – No Warranties

All items are sold “as is” and “where is”, with no warranties, guarantees, or representations of any kind, whether expressed or implied.

Condition, authenticity, functionality, and suitability for any purpose are not guaranteed. It is the bidder’s sole responsibility to inspect descriptions and photos prior to bidding. No refunds, exchanges, or price adjustments will be issued for any reason.

2. No Returns, Refunds, or Exchanges

All sales are final. Once an auction ends, the winning bidder is legally obligated to pay for their item(s) in full.

No refunds, credits, or exchanges will be provided due to buyer's remorse, misunderstanding, or failure to read descriptions. Placing a bid is a commitment to purchase.

3. Binding Bids – No Bid Retractions

All bids placed are final, legally binding, and non-retractable.

Bid retractions are NOT permitted under any circumstances. Placing a bid is a contractual obligation to complete the purchase if you are the highest bidder.

Any attempt to back out of a winning bid will result in suspension from bidding in future auctions.

4. Payment Policy – Declined Cards, Late Fees & Account Suspensions

Payment will be automatically processed using the registered card on file at the auction’s close. Ensure your payment method has sufficient funds.

Buyers who claim a tax exemption or wish to pay with cash must notify us before the auction ends; otherwise, your card will be charged automatically.

If your registered card is declined, you will be notified, and payment must be made within 24 hours. Failure to do so will result in:

A $25 late fee added to your invoice.

Suspension of bidding privileges until the balance is settled.

If unpaid by the end of the month, your account will be permanently banned from future auctions.

5. Sales Tax & Tax-Exempt Buyers

Sales tax will be charged automatically on all applicable purchases.

Buyers claiming sales tax exemption must submit valid documentation BEFORE bidding. If you fail to provide proof of exemption before the auction ends, you must pay the sales tax and claim it on your own when filing. No tax refunds will be issued after the auction closes.

6. Item Pickup – Late Fees, Forfeiture & Mandatory Full Lot Pickup

All items must be picked up during the designated pickup period. If you fail to do so, the following penalties apply:

Late Pickup Fee: A $25 fee will be added for late pickups beyond the scheduled time.

Abandoned Items Policy: Items not picked up within 10 days will be considered abandoned and forfeited, with no refunds or credits issued. The items will be resold or disposed of at our discretion.

Full Lot Pickup is Required: Buyers must pick up every item they win.

Cherry-picking lots is NOT allowed.

If a buyer refuses or fails to pick up all of their winning items, their buyer’s premium will be increased from 15% to 20% for future auctions.

Buyer Responsibility: We make reasonable efforts to contact winning bidders via email, text, or phone. Failure to respond within 10 days results in automatic forfeiture.

Failure to pick up items will not result in a ban; however, repeat offenders may have future bids restricted at our discretion.

7. Shipping Policy – Fees, Deadlines & Liability

Automatic Shipping for Buyers Over 100 Miles Away: If your registered address is 100+ miles from the auction location, your items will automatically be shipped at your expense.

Opting Out of Shipping for Local Pickup: You must notify us via email or text within 12 hours of the auction closing if you wish to pick up your items instead of having them shipped. Failure to notify us within the deadline will result in automatic shipping charges.

Shipping Costs & Handling Fees:

Shipping costs are calculated and charged at the same time as your winning bid.

A $5 per-lot handling fee applies, with a $50 maximum handling charge per invoice.

Mandatory Insurance: All shipped items will include insurance for the item's value (winning bid price) at the buyer's expense.

Shipping Liability Disclaimer: Once an item is shipped, we are not responsible for lost, stolen, or damaged packages. Any issues must be addressed directly with the carrier.

8. No Assistance with Loading or Packaging

Buyers must bring their own help, tools, and materials for pickup. Staff will not assist with lifting, loading, or securing items for transport.

9. Email List & Communication Consent

By registering for our auction, you agree to receive auction notifications, promotional offers, and business updates via email.

You may unsubscribe from promotional emails at any time, but transactional emails related to active auctions cannot be opted out of.

10. Communication Policies – Response Expectations

Primary communication method: Email

Secondary communication method: Text message

Phone calls are reserved for urgent matters only.

Buyers must respond to communications regarding payments, pickup, or shipping within 24 hours, or they may face penalties.

11. Failure to Comply – Account Suspensions & Permanent Bans

Failure to adhere to these terms will result in the following penalties:

Non-payment after 24 hours of a declined card: $25 late fee + account suspension.

Unpaid invoices at the end of the month: Permanent ban from all future auctions.

Repeated non-payments, chargebacks, or attempts to retract winning bids: Immediate and permanent ban.

Failure to pick up items within 10 days: Will result in forfeiture of items but not a ban.

Refusing to pick up full lots will result in an increase in the buyer’s premium from 15% to 20% for future auctions.

Abuse, harassment, or disrespect towards staff: Immediate and permanent ban.

By registering, bidding, and participating in our auctions, you acknowledge that you have read, understand, and agree to all terms and conditions outlined above.
