LIVE and ONLINE TERMS AND CONDITIONS FOR BIDDING ONLINE WITH
PROGRESSIVE AUCTION CO. LLC
ALL AUCTIONS ARE WITH RESERVE UNLESS SO NOTED AND ADVERTISED WITH THIS COMPANY
There will be a 18% Buyers Premium with will be added to the high bid to determine the total sales price of any and all items. Credit cards will automatically be charged at to the winning bidder at the end of the auction, subject to meeting any set reserves.
Bidders/Buyers paying by credit card agrees to be subject to the jurisdiction within the Auction Company’s City and State.
The Seller, Auctioneer and or the Auction Company are making representation nor is either party warranting the character, quality, or other attributes of the property sold at auction.
The burden of inspection of any property is solely on the bidders. They can either inspect the property prior to the bidding or waive inspection prior to the bidding.
All sales are final, and no refunds or returns are allowed.
The Bidder agrees that, should a charge back be initiated, the Bidder terms and conditions will be conclusive of Bidder’s waiver of any charge back rights.
In the event a charge back is successful, the Buyer remains liable for the purchase price, including any buyer’s premium and plus any and all cost of collection and attorney’s fees.
The chargeback rule is established to be consistent with applicable licensing requirements and ethical responsibilities required by the State of Virginia.
Packaging and shipping of any and or all items bought by the buyer will be the responsibility and expense of the buyer. The Auction Co. will provide a list of local packaging and shipping companies at the request of the successful bidders.
ADDITIONAL TERMS AND CONDITIONS
Once the Bidder has been declared the high bidder of any or all items, those items are then declared the bidder (s) and the high bidder takes full responsibility of those items. The Seller, his/her representatives, the Auctioneer, or his/her representatives will not be held responsible for any items once the bidder has been declared the high bidder of such items.
Credit card will be accepted for payment at this auction. All items must be paid for in full before removing items from the auction site. In the event the buyer renders a bad check to the Auctioneer, the bidder will be responsible for any and all cost to the Auctioneer required to collect the monies owed to the Auctioneer including any and all legal fees deemed necessary to collect the funds including any and all attorney’s fees.

There are no minimum starting bids; however, the Auctioneer reserves the right to set starting bids on select items, accept, or reject any and all offers on items at his/her sole discretion.
Conduct of the auction and increments of the sale shall be at the sole discretion of the Auctioneer.
The Auctioneer has the right to withdraw any item, postpone or cancel the auction at his/her sole discretion without notice and or modify or add any terms and conditions either prior to or at the auction.
By registering for this auction, you are entering into a legal binding contract with the Auction Co. and hereby agree and are bound to the terms and conditions presented by the Auction Co.
A pickup date will be set for this auction as well as times set for that date. In the event you fail to pick up your winning items during the set date and times your items (s) will be considered as abandoned and they will then become the property of the auction company. You will still be responsible for full payment of those items and your credit card will be charged accordingly.
The Auction company will ship your item (s) if you are out of the area and will advise you of the shipping charges prior to shipping. All shipping charges will be the responsibility of the buyer and will be charged to the buyer’s credit card in addition to the high bid cost and buyer’s premium for any and all items.
In accordance with the new law on sales tax, if your state requires sales tax to be paid when purchasing items from another state the appropriate sales tax will be charged.

Pick up times have been set for this auction and is indicated in this advertisement and will appear on the winning bidder’s emailed invoice prior to the pickup date and times. It will include the times and date of pickup.

Additional Conditions:
1. There are no minimum starting bids required for the property; however, Seller reserves the right to accept or reject all offers on the property. The auction shall be recorded, and if any disputes arise following the auction, the Auctioneer’s recorded records will be final in all aspects.

The Auctioneer makes no representation as to whether any parcel is classified as a buildable site. Seller and the Auctioneer and their agents shall not be liable for any damages, whether actual or direct or incidental, including without limitation, damages for loss of use or loss of income occurring by reason of condition of such property.
3. Commercial properties being purchased under these terms will be subject to these terms where appropriate and will not be subject to any required permits or licenses required or any other particular requirement to open or operate any type of business. The commercial property is also being sold in a as is, where is, and how is condition including but not limited to use for a particular purpose.
4. Taxes, sizes and square footage set forth for the property are approximations only, based on best information available, but actual taxes, sizes and square footage may be different.
5. The Seller and Auctioneer have the right to withdraw the property, postpone or cancel the auction at their sole discretion without notice and to modify or add any terms and conditions either prior to or at the auction. The Seller has the right to accept or reject any and all offers in reference to the listed property in this auction sale.
6. Persons buying in the Name of Trust, Partnerships, Corporations, or with a Power of Attorney must have the authorizing documents examined prior to the auction by a representative designated by the Seller.
7. Closing will be conducted by the Purchaser’s attorney and all costs legally chargeable to the Purchaser will be paid by the Purchaser.
8. This property is being offered for sale to purchasers without regard to prospective race, color, religion, sex, marital status, or national origin.
