Terms and Conditions for Jeffrey S. Evans & Associates
CONDITIONS OF SALE:
Potential bidders must establish an account with Jeffrey S. Evans & Associates to bid. Registration approval requires that all registrants be in good standing in the auction community. Those with accounts indicating negative bid or payment history may not be approved to bid. Bidder approval is at the sole discretion of Jeffrey S. Evans & Associates.
Your bid constitutes a legally binding contract.
By bidding with Jeffrey S. Evans & Associates, Inc. either directly or through an online bidding platform (e.g. Bidsquare, Invaluable, or LiveAuctioneers), you agree to abide by all associated auction terms.
1. The auctioneer reserves the right to reopen bidding on a sold lot (under extreme circumstances) and is the sole determinant concerning all bids.
2. All auction lots sold are subject to a buyer's premium.
3. Telephone bidding is not offered through third party bidding platforms such as Live Auctioneers. To place telephone bids, you must be registered on the JSEA Live bidding platform. Absentee bids may be placed through each bidder?s Live Auctioneers account. Jeffrey S. Evans & Associates is not responsible for errors regarding unexecuted or absentee bids. Bidders must contact Live Auctioneers Support to address errors or changes to a bid. Jeffrey S. Evans & Associates has no authority over a Live Auctioneers customer account.
4. We welcome international bidders; however, all communications must be in comprehensible English.
5. Verification of lot numbers prior to bidding is imperative. In the event of accidental bid, the buyer is still liable for payment as we are liable to the consignor.
6. Absentee bidders may be in competition with various LIVE bidders, which may include FLOOR or ON-SITE/IN-HOUSE bidders (bidding in person at our gallery), INTERNET bidders (bidding in real time via computer) or PHONE bidders (bidding in real time via telephone). Absentee bids may be placed through Live Auctioneers at any time prior to the sale of the item.
7. In the event of identical absentee bids, the earliest bid received takes priority. NOTE: It is possible that a "Live" bidder could win a lot for the same bid amount you placed prior to the auction (it depends on where the bidding opens and how it falls during sale of the lot).
8. Authorized telephone bids are subject to a minimum opening bid per lot of $250 for calls within the USA, and $500 for international calls. Phone bids must be arranged by 3:00 PM ET, the day prior to the auction. Requests submitted after the deadline may be rejected.
Telephone bids to be confirmed by the bidder in writing, (email acceptable), prior to acceptance and execution of the bids by staff.
9. Invoices will be sent to all successful Live Auctioneers bidders, via email, within two business days after the conclusion of the multi-day auction.
10. PAYMENT
*Jeffrey S. Evans does NOT accept direct payment from Live Auctioneers bidders.
*Payments for lots won as a LiveAuctioneers bidder are automatically charged to the credit card on file with Live Auctioneers ?Live Pay? within twenty-four hours of the closure of each respective auction.
*Won lots are not available for pick-up or payment until the bidder has received a Live Auctioneers invoice emailed through that bidding portal. The invoice must be paid prior to the removal of lots.
*International bidders through Live Auctioneers make payment by way of ACH transfer of funds through the Live Auctioneers payment portal. Bank wire payment may be made directly to Jeffrey S. Evans & Associates. Domestic and International wires incur an additional thirty-five-dollar fee to be added to the invoice. Intentions of wire payment must be emailed to info@jeffreysevans.com within two days from the auction for additional instructions. Fees imposed by Live Auctioneers such as tax and handling fees are collected by Live Auctioneers.

12. The buyer is liable for all fees/costs associated with the collection of balances due, including attorney's fees.
13. Unless arrangements have been made prior to the auction, any merchandise not removed within two weeks from the sale date is subject to a storage fee of five dollars per day, per small item, ten dollars per day, per large item. Any merchandise not removed within thirty days from the sale date is considered abandoned and becomes the property of Jeffrey S. Evans & Associates.
14. Invoices that are unpaid after twenty-five days are subject to five percent monthly finance charge; administrative fees may also apply.
15. REFUNDS
Refunds will be given at the sole discretion of a Jeffrey S. Evans & Associates Specialist and will only be considered on lots that are determined to be inauthentic, have major damage, or significant restorations/repairs that were not outlined in the condition report. Requests for refund will be submitted in electronically via email and sent to info@jeffreysevans.com with substantiating photographs. Refunds are not accepted via telephone request.
*Refund requests regarding authenticity must also include at least one supporting written and signed statement from an authority recognized by the auctioneer.
*Refunds for items purchased in person at the gallery must be requested before the item in question is removed from the gallery.
*All other refund requests, including any substantiating documentation, must be received in our office within 25 days of the UPS shipment date. Refunds relating to condition of items purchased in person at the gallery must be requested before those items are removed from the gallery. Consideration for return of items which are picked up by the buyer?s representative or third-party shipper must occur within twenty-five days from the auction in which the lot was sold. Absolutely no refund will be accepted after this deadline.
*Lots catalogued without circa dates are not guaranteed as to age.
*No refunds will be considered on Oriental rugs which are sold strictly "as is" with no guarantee as to age, origin or condition.
*Note: Your timeliness and type of payment directly affects the time allowed for a refund transaction.
*DO NOT return any item until a refund authorization has been obtained from Jeffrey S. Evans & Associates.
*Once a refund is approved AND the complete lot is returned in expected order to the satisfaction of the specialist, a full refund of the hammer price and buyer's premium will be issued. We do not refund shipping costs, nor do we offer partial refunds.
16. Additional conditions of sale may apply, as noted on our website and/or as announced by the auctioneer prior to the auction.
17. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the Commonwealth of Virginia.
18. FIREARM LAWS
*All post-1898 firearms will be registered and sold in compliance with all Federal and Virginia State Laws.
*All purchases must be approved through a Federal NICS background check. Buyers must be aware of their ability to pass a background check. Purchasers of Modern firearms must complete state and federal registration forms at Jeffrey S. Evans & Associates or provide a signed copy of a Federal Firearms License (FFL). Dealers and out-of-state buyers must have signed copies of their Federal Firearms License in their possession on the day of sale and present a valid form of government identification to accept same-day delivery of modern firearms.
*Within 48 hours from the close of the sale, out-of-state internet bidders are responsible for providing Jeffrey S. Evans & Associates with the name and contact information of a preferred FFL dealer in your state of residence who will be receiving the purchase. The preferred FFL dealer will in turn provide Jeffrey S. Evans & Associates with their Federal Firearms license.
*Shipping and insurance are handled through Jeffrey S. Evans & Associates. All items shipped UPS-ground or required overnight parcel for handguns, with insurance. All shipping quotes are for shipping within the continental U.S. only. All shipments will be to an authorized FFL dealer in your state of residence.
*The buyer is responsible for knowing their local, state, and country laws before bidding. If you are unable to purchase or own a firearm, please do not bid. Your bid constitutes a binding agreement to purchase.
*Jeffrey S. Evans & Associates does not claim to be experts in firearms. Clients will have due diligence in determining their condition.
*Firearms are sold in as is condition.
*A Curio and Relics (C&R) License is accepted on firearms classified as curios and relics, and does not require a background check; however, will follow the same transactional procedures as noted with an FFL.
*Jeffrey S. Evans & Associates reserves the right to refuse the transfer of a firearm.
19. CATALOGUE GUARANTEE:
GLASS & LIGHTING
*All catalogue descriptions are guaranteed to be accurate in the matter of authenticity, condition and measurements to within one inch, unless otherwise noted in the catalogue description.
*Many of the minor flaws noted are perfectly acceptable and do not detract from the item's desirability or value; however, we do not consider light wear, small manufacturing flaws, glass impurities, or lightly tinted glass to be notable flaws.
*If you are a bidder who demands flawlessness, we recommend item(s) be examined in person, or have a trusted representative inspect the item(s) on your behalf.
*Lamps measured to the top of the collar and are without burners and chimneys unless otherwise noted.
ANTIQUES, AMERICANA & DECORATIVE ARTS
*All catalogue descriptions are believed to be accurate in terms of authenticity and condition, but ultimately all lots are sold "as is".
*Antiques, by their very nature, will exhibit wear, minor losses and breaks, and small repairs commensurate with age.
*We note only those condition issues that significantly affect the integrity of the item in our opinion.
*Returns will only be considered for items found to be fake/reproduction and/or have significant damage/restoration not noted in the catalogue description.
*If you are a bidder who demands flawlessness, we recommend you examine the item(s) in person, or have a trusted representative inspect the item(s) on your behalf.
*All measurements are approximate. Please contact us if you require exact measurements.
*All Oriental rugs are sold strictly "as is" with no guarantees as to age, origin or condition. Absolutely no refunds will be considered on Oriental rugs.
*Fine jewelry is guaranteed only regarding gold content and authenticity of diamonds. Authenticity of other stones and grades of any stones are not guaranteed.
*All clocks, watches, music boxes, slot machines, firearms, wind-up toys, and other mechanical devices are sold without guarantee as to the working condition of each lot.
*We strive to describe accurately all aspects of each lot's condition, including that of mechanical devices, but cannot guarantee the strict accuracy of these reports specifically regarding working conditions or mechanical function. Bidders are encouraged to examine personally any lot with respect to mechanical working conditions.
20. ALL AUCTIONS
*All requests for additional information will be accepted until 3:00 pm ET the day before the auction. Call 540.434.3939, or email info@jeffreysevans.com.
*The auctioneer reserves the right to make verbal corrections and provide additional information from the auction block at the time of sale.
*Absentee bids will not be executed on lots found to be other than as described in the catalogue unless one of our representatives has personally conveyed the updated catalogue description to the absentee bidder. The bidder will then have the option to alter or cancel the original absentee bid.
21. SHIPPING
* Jeffrey S. Evans & Associates does not have in-house shipping services.
*Live Ship offered through Live Auctioneers. Defer to their terms and conditions for further information. Jeffrey S. Evans & Associates coordinates shipping with a Local UPS store for those Live Auctioneer bidders who select self-arranged shipping. In both cases, the receipt of shipped lots can take up to three weeks.
*Shipping for lots won through third party platforms is coordinated between Jeffrey S. Evans & Associates and a local UPS affiliate who will complete the shipping transaction. You will receive an email from ellen@jeffreysevans.com following the receipt of your invoice. This email contains shipping instructions. It is the bidder?s responsibility to fill out the shipping form and return it to the UPS store.
* Any items having outstanding shipping fees with shipping affiliates of Jeffrey S. Evans & Associates are subject to storage fees in accordance with the Conditions of Sale, paragraph 13, under Terms and Conditions.
* Jeffrey S.
