ALL THINGS ESTATE SALES
ONLINE AUCTION TERMS AND CONDITIONS
By registering for this auction and placing a bid, you agree to all terms and conditions listed below. Please read all terms carefully before bidding. Placing a bid is a legally binding agreement to purchase.
1. Bidding Agreement
All bids are final. By placing a bid, the bidder agrees to purchase the item if they are the winning bidder. Bidders are responsible for reviewing all descriptions, photographs, pickup information, payment requirements, shipping availability, and auction terms before bidding.
Failure to read or understand the terms does not relieve the buyer of their payment or pickup obligations.
All Things Estate Sales reserves the right to reject bids, remove bidders, cancel lots, correct catalog errors, reopen bidding, or make final decisions regarding bidding disputes.
2. Buyer’s Premium
A 15% Buyer’s Premium will be added to the final hammer price of each lot.
Example:
Winning Bid: $100
Buyer’s Premium: $15
Subtotal Before Tax: $115
Sales tax and any applicable fees will be added where required.
3. Payment
Payment is due following the close of the auction.
The credit card on file with HiBid may be charged automatically after the auction closes. All Things Estate Sales reserves the right to process payment within 24 hours of auction close.
Accepted payment methods may include:
Visa
Mastercard
Discover
American Express
Cash at pickup when approved
Wire transfer for larger invoices when required
Invoices over $1,000 may require wire transfer or certified funds at the discretion of All Things Estate Sales.
All declined cards, unpaid invoices, or failed payments must be resolved before pickup. Items will not be released until payment has cleared in full.
4. Cash Discount
A 3% discount may be offered for approved cash payments made during the scheduled pickup period.
Cash payment must be approved before the card on file is processed. Once a card payment has been processed, the cash discount will not apply retroactively.
5. Sales Tax
Washington State sales tax will be collected where required by law.
Resellers must provide a valid reseller permit before the auction closes or before payment is processed. Tax-exempt status cannot be applied after an invoice has already been paid unless approved by All Things Estate Sales.
6. As Is Where Is
All items are sold As Is Where Is with no warranties, guarantees, returns, refunds, exchanges, or credits.
Descriptions, measurements, photographs, maker information, condition notes, and any other details are provided as a courtesy only. All Things Estate Sales makes every effort to describe items accurately, but does not guarantee condition, authenticity, age, origin, completeness, working order, or value.
Bidders are encouraged to inspect items during preview when available and to ask questions before bidding.
7. Preview
Preview dates and times will be listed in the auction details when available.
Failure to preview an item does not relieve the buyer of their responsibility to pay for and pick up winning lots.
8. Auction Closing and Soft Close
This auction may use a soft close format. If a bid is placed within the final minutes of a lot closing, the closing time may automatically extend.
Bidders are encouraged to place their maximum bids early. All Things Estate Sales is not responsible for missed bids due to internet issues, device problems, HiBid delays, user error, or technical difficulties.
9. Standard Pickup Schedule
Unless otherwise stated in the auction catalog, All Things Estate Sales generally conducts pickup on the Tuesday and Wednesday immediately following the close of the auction.
Standard pickup hours are:
Tuesday: 10:00 AM to 5:00 PM
Wednesday: 10:00 AM to 5:00 PM
Exact pickup dates, times, and location will be listed in each auction.
Buyers are responsible for picking up all purchases during the scheduled pickup period. Failure to pick up during the scheduled pickup period does not relieve the buyer of payment responsibility.
10. Pickup Requirements
Buyers are responsible for bringing all necessary help, tools, boxes, packing materials, moving equipment, and transportation needed to safely remove their purchases.
Auction staff may be unable to assist with loading.
For furniture, appliances, safes, shop equipment, large lots, or oversized items, buyers must bring adequate help and proper equipment. All items must be removed safely and without damage to the property.
Any damage caused during removal may be the responsibility of the buyer.
11. Alternate Pickup Arrangements
Alternate pickup arrangements must be requested before the end of the scheduled pickup period and must be approved in writing by All Things Estate Sales.
Approval is not guaranteed and is at the sole discretion of All Things Estate Sales.
Storage fees, holding fees, handling fees, and additional labor fees may apply to any approved alternate pickup arrangement.
12. Missed Pickup Fee
Any buyer who fails to pick up during the scheduled pickup period without prior written approval will be charged a $25 missed pickup fee per invoice.
This fee is in addition to any storage fees, holding fees, handling fees, disposal fees, or other costs that may apply.
13. Warehouse Holding and Storage Fees
Warehouse and storage space is limited and has real operating costs. Items left after the scheduled pickup period take up valuable warehouse, staging, and operating space.
Any items remaining after the final scheduled pickup day will be subject to holding and storage fees as follows:
Standard lots: $10 per day
Furniture, appliances, oversized lots, palletized lots, large group lots, safes, equipment, or other bulky items: $25 per day per item or lot
Storage and holding fees begin after the final scheduled pickup window ends.
Storage and holding fees must be paid in full before any items are released.
All Things Estate Sales reserves the right to charge the card on file for missed pickup fees, storage fees, holding fees, handling fees, disposal fees, and any other unpaid balance connected to the buyer’s invoice.
14. Abandoned Property
Items not removed within 7 calendar days after the final scheduled pickup day will be considered abandoned unless prior written arrangements have been approved by All Things Estate Sales.
Abandoned items may be resold, donated, disposed of, retained, moved, or otherwise liquidated at the sole discretion of All Things Estate Sales.
The original buyer forfeits all ownership rights to abandoned property and will not be entitled to any refund, credit, chargeback, or compensation.
The buyer remains responsible for any unpaid invoice balance, buyer’s premium, taxes, missed pickup fees, holding fees, storage fees, handling fees, disposal costs, collection expenses, and related charges.
15. Shipping
Shipping is available only on select lots or when approved by All Things Estate Sales.
Buyers requiring shipping must notify All Things Estate Sales within 72 hours of auction close.
The buyer is responsible for all shipping costs, packing materials, handling fees, insurance, and any third-party shipping charges.
Shipping invoices must be paid in full before items are shipped.
Large furniture, appliances, oversized items, fragile items, heavy items, hazardous materials, and certain specialty items may be pickup only.
All Things Estate Sales reserves the right to refuse shipping on any item.
16. Failure to Pay
Failure to pay for winning bids may result in:
Suspension from future auctions
Reporting to HiBid
Collection efforts
Legal action
Loss of bidding privileges
Forfeiture of items
Bidders are responsible for all costs related to unpaid invoices, including collection costs, legal fees, storage fees, handling fees, and administrative fees where permitted by law.
17. Chargebacks and Payment Disputes
By registering and bidding, the buyer agrees that all sales are final and that they will not initiate a chargeback or payment dispute for items purchased under these terms.
Buyers agree to contact All Things Estate Sales directly to resolve any payment or pickup issue before initiating a dispute with their bank or credit card provider.
A chargeback or payment dispute may be considered a breach of these terms and may result in suspension from future auctions, collection efforts, and recovery of fees or costs associated with the dispute.
18. Bid Retractions and Bidding Errors
Bids cannot be withdrawn once placed.
Bidders are responsible for confirming the item, bid amount, and quantity before placing a bid. All Things Estate Sales is not responsible for bidding mistakes or user error.
19. Catalog Errors and Lot Changes
All Things Estate Sales makes every effort to provide accurate information, but errors may occur.
All Things Estate Sales reserves the right to correct descriptions, remove lots, combine lots, divide lots, update photographs, change terms, or cancel sales when necessary.
If there is a conflict between the general terms and auction-specific terms listed in a particular auction, the auction-specific terms shall control.
20. Technology Disclaimer
All Things Estate Sales is not responsible for technical issues, including but not limited to:
Internet outages
HiBid platform issues
Device failure
Browser issues
Delayed bids
Missed bids
Software errors
Power outages
User error
Bidders are encouraged to bid early and use the maximum bid feature when appropriate.
21. Liability
Buyers assume all risk and responsibility for the purchase, pickup, loading, removal, transport, ownership, use, and resale of purchased items.
All Things Estate Sales, its owners, employees, representatives, clients, consignors, and property owners shall not be liable for injury, loss, damage, accident, or expense arising from the inspection, purchase, pickup, removal, transport, use, or resale of any item.
Buyers enter the pickup location at their own risk.
22. Firearms and Regulated Items
Any firearm, ammunition, weapon, or regulated item will be sold only in compliance with all federal, state, and local laws.
Firearm purchases may require transfer through a licensed FFL dealer. Buyers are responsible for all transfer fees, background checks, shipping charges, and legal requirements.
All Things Estate Sales reserves the right to refuse the sale or transfer of any regulated item if legal requirements are not met.
23. Governing Law and Venue
These terms and conditions shall be governed by the laws of the State of Washington.
Any legal dispute shall be handled in the appropriate court located in King County, Washington, unless otherwise required by law.
24. Agreement to Terms
By registering for this auction and placing a bid, the bidder acknowledges that they have read, understood, and agreed to all terms and conditions.
Bidding confirms acceptance of these terms and creates a binding purchase agreement between the buyer and All Things Estate Sales.
