Terms and Conditions of Sale

1. Buyer's Premium

A Buyer?s Premium equal to twenty percent (20%) of the final Hammer Price shall be added to the price of each Lot and is payable by the Buyer.

2. Condition of Items and Disclaimer of Warranties

A. "As Is, Where Is" Sale: All items (Lots) are sold "as is, where is" with no guarantees, representations, or warranties, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.

B. No Representations: No representations are made by Dust Factory Auctions LLC regarding the age, condition, authenticity, or provenance of any Lot.

C. Finality of Sale: All sales are final.

3. Bidder Due Diligence and Examination

A. Bidder Responsibility: Bidders are solely responsible for reviewing all item details, photographs, and conducting independent research before placing a bid.

B. Auctioneer Opinion: Item descriptions reflect the auctioneer?s opinion only and are not guaranteed as factual representations.

C. Acknowledgment: By placing a bid, the Buyer acknowledges and agrees to rely solely on their personal judgment, examination, and assessment of the Lot.

D. Item Examination: No public viewing period is offered. Requests for additional information or images may be submitted via email to dustfactoryauctions@gmail.com. These requests are subject to the auctioneer?s sole discretion and may be declined due to operational scheduling or availability.

4. Sales Tax and Payment Terms

A. Sales Tax: Applicable sales tax will be added to the Buyer?s invoice and collected by LiveAuctioneers.

B. Autopay Authorization: Invoices are processed through LiveAuctioneers? 24-Hour Autopay system. If a valid payment card is on file, it will be automatically charged within 24 hours of invoice issuance.

C. Alternative Payment: Buyers wishing to use an alternative payment method must contact the auction house within that 24-hour window.

D. Payment Sufficiency: All payment methods must be valid and sufficiently funded to cover the total amount due.

5. Default and Late Payments

Failure to complete payment within the required timeframe may result in cancellation of the order, forfeiture of the items, and restriction from future auctions. For complete payment policies, Bidders must refer to LiveAuctioneers? LIVE Payment Policies. Buyers agree to comply with all LiveAuctioneers policies regarding LIVE Payments and bidder obligations.

6. Shipping and Local Pickup

A. Shipping: Shipping is provided exclusively through LiveAuctioneers? LIVE Shipping service. A flat handling fee of $15 per auction, regardless of lot count, will be added to invoices for shipped items. No other shipping services are offered. Full details are governed by LiveAuctioneers? LIVE Shipping policies.

B. Local Pickup - Scheduling: Buyers opting for local pickup must schedule an appointment within 3 business days of the auction close by emailing auctions@dustfactoryauctions.com.

Available pickup windows are:

Monday?Wednesday: 5:00 PM?7:00 PM

Thursday?Friday: 1:00 PM?5:00 PM

Saturday?Sunday: 9:00 AM?12:00 PM

C. Local Pickup - Payment: Buyers intending to pay with cash or check at pickup must indicate this in their scheduling email so an updated invoice can be issued. Otherwise, invoices will be processed automatically through LiveAuctioneers? 24-Hour Autopay system (see Section 4).

D. Non-Scheduled Pickup: Buyers who arrive without a scheduled appointment will be turned away.

E. Abandonment: Items not picked up within the designated 3-business-day window will be considered abandoned and are non-refundable.

7. Bidder Requirements and Security

A. Age Requirement: All bidders must be at least 18 years of age.

B. Account Security: Bidders are required to provide accurate registration details. All bids placed under a registered account are the sole responsibility of the account holder.

8. Online Bidding Disclaimer and Auctioneer's Rights

A. Platform Disclaimer: LiveAuctioneers is the designated platform for online bidding. Dust Factory Auctions LLC is not liable for missed bids or service interruptions resulting from technical issues or failures of the online bidding platform.

B. Auctioneer's Reserved Rights: The auctioneer reserves the right, at any time and at their sole discretion, to pause, delay, restart bidding, withdraw items, or re-catalog lots.
