1. Conditions of Sale
This is a public auction conducted by Best Estate Services, Inc. (?Auctioneer?), which acts solely as agent for the consignor or seller unless otherwise expressly stated.
By registering to bid and/or placing a bid, each bidder agrees to these Terms & Conditions, the auction-specific listing and notices, and applicable LiveAuctioneers platform, LivePayments, and LiveShipping terms. These auction terms do not supersede mandatory platform requirements, applicable buyer protections, or rights that cannot be waived by law.
A successful bid constitutes a legally binding agreement to purchase, and the successful bidder assumes full responsibility for payment and removal of the property in accordance with these Terms & Conditions.
2. Catalog Descriptions; Condition; As-Is Sale
All lots are sold AS IS, WHERE IS, WITH ALL FAULTS, and without any representation or warranty, express or implied, including but not limited to any warranty as to authenticity, attribution, authorship, age, origin, condition, size, quality, rarity, provenance, importance, historical relevance, or fitness for a particular purpose.
Best Estate Services, Inc. endeavors in good faith to identify, catalog, photograph, and describe each lot as accurately as reasonably possible based on the information available at the time of cataloging. Catalog descriptions, photographs, dimensions, and condition comments are provided solely as a courtesy for identification and general guidance. They are statements of opinion only and shall not be relied upon as statements of fact, guarantees, or warranties.
No oral statement or written statement made by the Auctioneer, its employees, or representatives shall be deemed a warranty or guarantee unless expressly stated in writing by the Auctioneer.

Prospective bidders are strongly encouraged to inspect property prior to bidding. If in-person inspection is not possible, bidders are responsible for requesting additional information, condition comments, or photographs before placing a bid.
Because many lots are antique, vintage, used, or estate property, they may exhibit age, wear, repairs, restorations, alterations, losses, imperfections, or other condition issues not specifically noted in the catalog description or photographs. The absence of a condition statement does not imply that a lot is free from defects.
By bidding, each bidder acknowledges that they have had the opportunity to inspect the property and are relying solely on their own judgment in determining the condition, value, and suitability of the lot.
4. Online Bidding; Technical Issues; Closing of Lots
This is an online timed auction conducted exclusively on LiveAuctioneers. Bidding increments, lot closing times, and any automatic extensions are those displayed for this auction on the platform. Bidding depends on third-party technology, internet connectivity, software, servers, and devices. Best Estate Services, Inc. shall not be responsible for missed bids, delayed bids, failed transmissions, platform interruptions, browser issues, internet outages, or other technical failures beyond its reasonable control.
Because of internet latency or device-related delay, bids placed at the last moment may not be received or recorded in time. Bidders are encouraged to refresh their browser near the close of bidding and to use the Max Bid feature whenever possible.
Final auction results shall be based on the records maintained by the bidding platform and the Auctioneer. In the event of a dispute, clerical error, or technical malfunction, the Auctioneer shall have sole discretion to determine the successful bidder, reopen bidding, withdraw a lot, cancel a sale, or otherwise resolve the matter.
5. Buyer?s Premium and Additional Charges
The total purchase price for each lot shall consist of the hammer price plus the applicable buyer?s premium and any other applicable charges.

$0 to $2,500: 20%
$2,501 to $5,000: 18%
$5,001 and above: 15%
Applicable LivePayments processing or service fees, if any, will be those disclosed by LiveAuctioneers at checkout.
The total amount due may also include applicable taxes, shipping charges, packing charges, handling charges, storage charges, insurance charges, and any other charges specifically disclosed in the auction listing or invoice.
6. Payment Terms
All purchases must be paid in U.S. Dollars (USD) through LiveAuctioneers? LivePayments service (also referred to as LivePay). Winning bidders should access their invoice in their LiveAuctioneers account and complete payment through the platform?s secure checkout.
Payment methods are those offered to the buyer by LivePayments at checkout, including eligible credit/debit cards and bank transfer by eCheck/ACH where available. Availability, transaction limits, verification requirements, and applicable processing fees are determined by LiveAuctioneers and its payment providers.
Buyers must pay by the deadline stated on their LiveAuctioneers invoice or payment notice. If automatic payment collection is enabled for this auction, LiveAuctioneers may charge the eligible card on file for an invoice remaining unpaid for 72 hours, in accordance with the platform?s notices and payment terms. Buyers remain responsible for payment if an automatic charge is declined or unavailable.
Property will not be released for shipment or local pick-up until LivePayments confirms cleared payment and all amounts due, including applicable shipping charges, have been paid. Allow sufficient time for bank-payment clearance before a scheduled pick-up. Payment questions or account issues should be directed to LiveAuctioneers support, with our office notified of any issue affecting fulfillment.
7. Shipping and Local Pick-Up
Shipping is available through LiveAuctioneers? LiveShipping hybrid program. Depending on the lot?s shipping requirements, fulfillment will use either full-service shipping through a LiveShipping provider or eLabel shipping, with Best Estate Services, Inc. preparing the shipment using labels supplied through LiveShipping.
Buyers are responsible for shipping, packing, handling, freight, insurance, and delivery charges disclosed for their selected shipping service. These charges are additional to the hammer price and buyer?s premium. Review the lot?s shipping options and available quote before bidding; contact us in advance if a quote or suitable option is unavailable, particularly for instruments, framed art, oversized, fragile, or specialty items.
Select shipping or local pick-up through the LiveAuctioneers checkout process, where available. Shipping charges and payment are handled through LiveAuctioneers rather than a separate shipping platform. Buyers must provide an accurate delivery address and complete any requested shipping information before fulfillment. No property will be released until payment has cleared and the invoice and applicable shipping charges are fully paid.
Shipment status and tracking are available through LiveAuctioneers. LiveShipping shipments include insurance subject to the applicable program terms, coverage limits, and exclusions. Report shipping damage, loss, or delivery problems promptly to LiveAuctioneers/LiveShipping and notify our office; retain packaging and photographs for any claim. Delivery dates and carrier performance are not guaranteed. Nothing in these auction terms eliminates applicable LiveShipping insurance or buyer rights.
Local Pick-Up
Local pick-up is available on the following two days:

Buyers are responsible for collecting their purchases and bringing suitable packing materials, transportation, and loading assistance.
8. Storage and Abandoned Property
Local pick-up purchases must be collected by the end of the second scheduled pick-up day stated above, unless the Auctioneer approves an extension in writing. Buyers selecting shipping must complete payment and arrange LiveShipping within two (2) weeks of the auction close, unless otherwise agreed in writing. Storage charges will not be assessed solely because of a LiveShipping fulfillment delay after the buyer has paid and completed the required shipping arrangements.
Items remaining beyond that time will incur storage charges of:
$10.00 per lot, per day
regardless of size or value.
If property is not paid for, picked up, or shipping arrangements are not completed within the required time, the Auctioneer reserves the right to assess storage charges, transfer the property to storage at the buyer?s risk and expense, cancel the sale, resell the property, or exercise any other rights permitted by law.
9. Third-Party Services and Consignor Disclosure
Best Estate Services, Inc. acts as auctioneer and agent for consignors and third-party sellers and, unless expressly stated otherwise, is not the owner of the property offered for sale.
Best Estate Services, Inc. uses LiveAuctioneers for online bidding, LivePayments (LivePay) for payment processing, and LiveShipping for shipping coordination and fulfillment, together with their payment processors, fulfillment partners, carriers, and other service providers necessary to administer the sale. By registering and bidding, each bidder authorizes the sharing of information reasonably necessary to complete the transaction, subject to the applicable privacy policies.
Descriptions, condition statements, provenance information, and other lot information may be based in whole or in part on information supplied by the consignor or obtained from third-party sources. While Best Estate Services, Inc. endeavors in good faith to accurately identify and describe each lot, the Auctioneer does not guarantee the completeness or accuracy of such information and shall not be liable for errors, omissions, or misattributions.
Third-party providers are independent contractors. Best Estate Services, Inc. shall not be responsible for delays, errors, service failures, loss, or damage caused by any third-party platform, shipper, carrier, or service provider.
10. Auctioneer?s Rights
The Auctioneer reserves the right, in its sole discretion, to withdraw any lot, reject any bid, reopen or extend bidding, divide or combine lots, cancel or reschedule any sale, refuse service, require proof of identity or funds, or resolve any dispute as it deems appropriate.
The Auctioneer?s records shall be final and conclusive in the event of any dispute concerning bidding, payment, or the sale of any lot.
11. Limitation of Liability
To the fullest extent permitted by law, Best Estate Services, Inc., its officers, employees, agents, representatives, and consignors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the auction, any lot, bidding, payment, shipping, storage, pick-up, or the use of any third-party service provider or online platform.
In any event, the maximum liability of Best Estate Services, Inc. with respect to any lot shall not exceed the hammer price actually paid for that lot.
12. Acceptance of Terms
By registering, bidding, purchasing, or otherwise participating in this auction, each bidder and buyer acknowledges that they have read, understood, and agreed to these Terms & Conditions in their entirety.
