ALL PROPERTY IS SOLD AS IS, WHERE IS, WITH ALL FAULTS. This is not an
approval sale. All sales are final. No returns, refunds, credits, or exchanges will be
permitted under any circumstances.

1. Agreement to Terms
By registering to bid and/or placing a bid in any auction conducted by Best Estate Services,
Inc. ("Auctioneer"), you acknowledge that you have read, understood, and agreed to these
Terms & Conditions in their entirety, together with any additional terms, notices, lot-specific
announcements, invoices, or shipping terms published by the Auctioneer or the bidding
platform.
The Auctioneer acts solely as agent for the consignor or seller unless otherwise expressly
stated in writing.
A successful bid constitutes a legally binding agreement to purchase. The successful bidder
assumes full responsibility for payment and removal of the property in accordance with these
Terms & Conditions.

2. All Sales Final — As-Is, Where-Is
All lots are sold AS IS, WHERE IS, WITH ALL FAULTS, without any representation or warranty
of any kind, express or implied — including but not limited to any warranty as to authenticity,
attribution, authorship, age, origin, condition, size, quality, rarity, provenance, or fitness for a
particular purpose.
Best Estate Services, Inc. makes every reasonable effort to accurately identify, catalog,
photograph, and describe each lot. However, all catalog descriptions, photographs (including
digital renderings), dimensions, and condition comments are provided as a courtesy for general
identification purposes only. They are statements of opinion, not statements of fact, and
shall not be relied upon as guarantees or warranties.

Please note: Photographs, digital renderings, and any AI-assisted descriptions are
provided for general reference only and may not accurately represent color, scale,
texture, or condition.
No oral or written statement by the Auctioneer, its employees, or representatives shall constitute
a warranty or guarantee unless expressly stated in a signed writing by an authorized officer of
Best Estate Services, Inc.

3. Inspection & Bidder Responsibility
Prospective bidders are strongly encouraged to inspect all property prior to bidding. If in-
person inspection is not possible, it is the bidder's responsibility to request additional
photographs, condition details, or information before placing a bid.
Because many lots are antique, vintage, used, or estate property, items may exhibit age, wear,
repairs, restorations, alterations, losses, or other imperfections not specifically noted in the
catalog. The absence of a condition statement does not mean a lot is free of defects.
By placing a bid, each bidder confirms that they:
● Have had the opportunity to inspect the property or have chosen not to do so;
● Are relying solely on their own judgment as to condition, value, and suitability; and
● Expressly waive any right to dispute the sale on the basis of condition,
authenticity, or description, whether or not an in-person inspection was conducted.

4. Online Bidding & Technical Issues
This is an online auction. Bidding depends on third-party technology, internet connectivity,
software, servers, and the bidding platform. Best Estate Services, Inc. is not responsible for
missed bids, delayed bids, failed transmissions, platform interruptions, or other
technical failures beyond its reasonable control, and shall not be liable for any direct or indirect
damages resulting from a bidder's inability to place or complete a bid.
Tips for bidders:
● Refresh your browser near the close of bidding.
● Use the Max Bid feature whenever possible to protect your position.
● Do not wait until the last moment — internet latency may prevent your bid from being
recorded in time.

The Auctioneer reserves the right to extend bidding, in its sole discretion, in the event of
platform interruption or technical malfunction, without notice or obligation to any bidder. Final
auction results are based solely on the records maintained by the bidding platform and the
Auctioneer. In the event of any dispute, the Auctioneer's records shall be final and conclusive.

5. Buyer's Premium & Fees
The total purchase price for each lot consists of the hammer price plus the applicable buyer's
premium and any other applicable charges.
Buyer's Premium Schedule
The buyer's premium is calculated on a tiered basis, applied independently to each pricing tier:

$0 – $2,500 20%
$2,501 – $5,000 18%
$5,001 and above 15%
Example: On a $3,000 hammer price — 20% is applied to the first $2,500 ($500), and 18% is
applied to the remaining $500 ($90), for a total buyer's premium of $590.
Additional Charges
● Credit/Debit Card Processing Fee: 3% added to all card payments
● Applicable taxes, shipping, packing, handling, storage, insurance, and any other charges
specifically disclosed in the auction listing or invoice

6. Payment Terms
All purchases must be paid in U.S. Dollars (USD). Payment is due promptly following the close
of the auction.

Please note: American Express is not accepted. Cash is not accepted at any
pick-up location.
For purchases under $1,500: Payment may be made by credit/debit card, cashier's check, or
wire transfer. Unless other arrangements are approved in advance, the credit card on file may
be automatically charged following the close of the auction. By registering to bid, you authorize
Best Estate Services, Inc. to charge your card on file for eligible invoices.
For purchases over $1,500: Payment must be made by cashier's check or wire transfer
only. The Auctioneer reserves the right to require a bank letter of reference or other proof of
funds before releasing property.

Non-Payment & Default
Failure to pay in full by the stated deadline constitutes a default. In the event of default, Best
Estate Services, Inc. reserves the right to cancel the sale, resell the property, suspend or revoke
the buyer's bidding privileges, and pursue all available legal remedies — including collection of
the full purchase price, buyer's premium, applicable storage charges, and all costs of collection,
including reasonable attorney's fees.
Returned checks will incur a $50.00 returned check fee and may result in immediate
suspension of bidding privileges.
Shipping, packing, handling, insurance, and related charges are invoiced separately through
Shipping Saint. Property will not be released until all amounts due — including the lot invoice
and shipping invoice — have been paid in full with cleared funds.

7. Shipping & Local Pick-Up
Buyers are solely responsible for all shipping, packing, handling, freight, insurance, and delivery
costs. Shipping is not included in the hammer price or purchase price unless expressly stated
in the listing.

How Shipping Works
Shipping coordination and invoicing are handled through Shipping Saint, our third-party
shipping partner. A separate shipping invoice is generally issued within five (5) business days
following auction close. Shipping charges are based on the carrier's rates plus packing and
handling fees, which vary based on the size, shape, fragility, and shipping requirements of
the item.
Tracking information will be provided when available.
Important: Once property has been tendered to Shipping Saint or a carrier, Best
Estate Services, Inc. has no further responsibility for the property. All claims
for loss or damage in transit must be filed directly with the carrier or shipping
provider. Best Estate Services, Inc. does not guarantee shipping rates, delivery
times, or carrier performance.
Best Estate Services, Inc. reserves the right to decline shipping of certain lots at its sole
discretion, including items prohibited by carrier regulations, hazardous materials, or items
requiring specialized transport. Bidders with concerns about oversized, fragile, or high-value
items are encouraged to contact us before bidding to confirm shipping availability.
Local Pick-Up
Local pick-up is available only when expressly stated in the auction listing. Unless
otherwise noted, all items will be shipped.
When local pick-up is offered, all property must be removed within the stated pick-up window or
any extension approved in writing by the Auctioneer.

8. Storage & Abandoned Property
All items must be picked up or have shipping arrangements completed within two (2) weeks of
the auction close, unless otherwise agreed in writing by the Auctioneer.
Items remaining beyond that time will incur storage charges of $10.00 per lot, per day,
regardless of size or value.
If property remains unclaimed for thirty (30) days following auction close, and the buyer has
been provided reasonable notice, the property may be deemed abandoned and disposed of in
accordance with applicable Wisconsin law (Wis. Stat. § 177 et seq.). Best Estate Services, Inc.
shall not be liable for any loss in value resulting from such disposition.

If property is not paid for or collected within the required timeframe, the Auctioneer further
reserves the right to cancel the sale, transfer the property to storage at the buyer's risk and
expense, resell the property, or exercise any other rights permitted by law.

9. Third-Party Services
Best Estate Services, Inc. acts as auctioneer and agent for consignors and third-party sellers
and, unless expressly stated otherwise, is not the owner of the property offered for sale.
Best Estate Services, Inc. may use third-party service providers in connection with the auction,
including BidSquare (online bidding), Shipping Saint (shipping coordination), payment
processors, carriers, packers, and freight companies. By registering and bidding, each bidder
authorizes the Auctioneer to share information reasonably necessary to complete the
transaction with such providers.
Third-party providers are independent contractors. Best Estate Services, Inc. is not
responsible for delays, errors, service failures, loss, or damage caused by any third-party
platform, shipper, carrier, or service provider.
Privacy & Data
By registering, bidders consent to the collection, use, and sharing of their personal information
as reasonably necessary to administer the auction and facilitate transactions. Best Estate
Services, Inc. does not sell personal information to unaffiliated third parties. For questions about

10. Auctioneer's Rights
The Auctioneer reserves the right, in its sole discretion, to:
● Withdraw any lot before or after the close of bidding
● Reject any bid for any reason
● Reopen, extend, or cancel bidding
● Divide or combine lots
● Cancel or reschedule any sale
● Require proof of identity or proof of funds
● Revoke or suspend any bidder's registration or bidding privileges, at any time, with or
without cause
● Resolve any dispute as it deems appropriate

The Auctioneer's records shall be final and conclusive in the event of any dispute concerning
bidding, payment, or the outcome of any sale.

11. Limitation of Liability & Indemnification
Limitation of Liability
To the fullest extent permitted by law, Best Estate Services, Inc., its officers, employees,
agents, representatives, and consignors shall not be liable for any indirect, incidental, special,
consequential, or punitive damages arising out of or relating to the auction, any lot, bidding,
payment, shipping, storage, pick-up, or the use of any third-party service or platform —
including in cases of negligence, to the extent permitted by applicable law.
In all events, the maximum liability of Best Estate Services, Inc. with respect to any lot shall
not exceed the hammer price actually paid for that lot.
Buyer Indemnification
Each buyer agrees to indemnify, defend, and hold harmless Best Estate Services, Inc., its
officers, employees, agents, and consignors from and against any claims, damages, losses, or
expenses — including reasonable attorney's fees — arising from the buyer's breach of these
Terms & Conditions or misuse of purchased property.

12. General Provisions
Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of
the State of Wisconsin, without regard to its conflict of laws principles. Any dispute arising
hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in
Waukesha County, Wisconsin.
Force Majeure
Best Estate Services, Inc. shall not be liable for any failure or delay in performance due to
circumstances beyond its reasonable control, including but not limited to acts of God, natural
disasters, government actions, pandemics, power failures, or utility outages.
Intellectual Property

All catalog content, photographs, descriptions, and other materials published by Best Estate
Services, Inc. are its exclusive property and may not be reproduced, distributed, or used without
prior written permission.
Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court
of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms & Conditions, together with any lot-specific notices or announcements, constitute
the entire agreement between the parties and supersede all prior representations, warranties,
or understandings, whether oral or written.
