Thank you for bidding with Nutmeg & Bittersweet. We appreciate your business! PLEASE REVIEW AND UNDERSTAND
THE FOLLOWING TERMS & CONDITIONS. These terms & conditions form a legal
agreement so please read carefully and if you have any questions please email
Nonnewman@gmail.com. If inquiring about an item in one of our auctions and
your question is already addressed in the description or terms, do not expect a response
back due to the amount of calls we address. THANK YOU!

• To Bid: You will need to register for our auction online. You must be 18 years of age or
older to bid. We will ask for general information and credit card authorization. Again,
please read the following terms and conditions carefully as they are a legal binding
contract between you (the bidder) and Nutmeg & Bittersweet. To register and bid in
this auction, you must agree to these terms and are bound by them as a bidder. Once you
place a bid through our bidding platform, you cannot remove or lower a bid. No bids will be
removed once they have been placed. Due diligence is the responsibility of you (the
bidder). All sales are final. When the bidding ends on our website and you are the high
bidder, you then assume complete responsibility for care of each purchase, including
payment, calling for an appointment to pick up and working with 3rd parties for shipping
or pick up if applicable. Nutmeg & Bittersweet is not responsible for internet malfunctions, loss of
connection or system glitches that may prevent you from placing last minute bids, or
receiving notices from our company. Don’t wait until the last minute to bid; if the system is
busy, your bids may not process within the last seconds of an auction closing. Our auctions
feature extended bidding. If a bid is placed on a lot within the last 2 minutes of the auction
item, bidding will extend on that lot for 2 minutes past the closing time. That lot will
remain open until there are no other bids on that item.

• Buyer’s Premium: THERE IS NO BUYER'S PREMIUM!!!!

• Condition: Before you place a bid with Nutmeg & Bittersweet, we strongly
recommend prospective bidders to examine lots in person prior to placing a bid.
Nutmeg & Bittersweet staff make every attempt to note any issue(s) with condition or item damages in the lot
description, but it is the responsibility of the bidder to determine lot condition prior to
bidding. The lack of any noteS by Nutmeg & Bittersweet as to the condition of the lot does not imply that the
lot is free of wear and tear. Unless otherwise stated, all lots are sold “AS IS, WHERE IS,”
and all sales are final. We will not give refunds for condition or shipping issues.
All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the
responsibility of the buyer to determine the condition of the items, based on photos and
descriptions, and bid accordingly. All items must be considered used or previously owned.
NO REFUNDS WILL BE ISSUED.
Nutmeg & Bittersweet staff does not test or verify conditions or completeness of items being offered
unless stated otherwise. Buyer has the right to test/inspect items at the preview dates.

• Catalog: Nutmeg & Bittersweet reserves the right to add or remove items from the auction; split or
combine lots; ad minimum bids or reserve prices. Nutmeg & Bittersweet reserves the right to cancel,
suspend, extend or reschedule an individual item and/or auction event or to make changes
to the auction closing times. Information in catalogs and other advertisements are from
sources believed to be reliable; however prospective purchasers are urged to inspect the
inventory or property to satisfy themselves as to condition, model, manufacturer, year,
features, mileage, survey, acres, etc. Neither Nutmeg & Bittersweet nor our client make any guarantees
and are not responsible for listing or advertising inaccuracies or discrepancies.

• Payment: Payment for all purchases is due at the conclusion of the auction via online
payment. Buyer agrees not to initiate any credit card charge backs for
purchases made, and agrees that NO refunds will be given. Payment for any titled item,
such as autos, boats, trailers and some ATVs will require a wire transfer of funds in full
before being released to the buyer. A valid credit card is required for bidding approval. No other payment method will
be allowed. At the conclusion of the auction, you hereby
authorize Nutmeg & Bittersweet to charge the purchase price to the credit card on your profile. You will not be able to pick
up or ship your item(s) until it has been paid in full.

• Pick-up: BY APPOINTMENT ONLY. Thursday, May 22nd and Friday, May 23rd. Due to location of sale, we will need to
schedule each appointment. You will receive an email invoice from us after the online
auction and we will start to schedule appointments for pick-up on May 22nd and 23rd, but it is YOUR
RESPONSIBILITY TO CALL US AND SCHEDULE YOUR PICK UP TIME WITHIN 24 HOURS OF THE AUCTION'S CONCLUSION.
Time slots will be limited, So please call as soon as possible to reserve
your desired time slot. Pick up slots will be scheduled during the designated
days as described above. If you are unable to pick up during the
designated pick up time, you must send a representative to pick up for you or forfeit your
items. Please do not bid if you can’t pick up during the designated timeline. Pick up times
are strict start and end times, you will need to arrive on time to pack and remove all your
items within your designated pick-up time. If you have any questions or concerns about
pick up please email Nonnewman@gmail.com BEFORE bidding. You must provide
your own packing materials, moving equipment, and adequate manpower to safely and
properly remove your items during the specified pick-up time.

• Failure to Pick Up: Winning bidders must pick up or have lots shipped within 5 business
days of the close of this auction. After 5 business days the item/s will be considered
abandoned unless other arrangements have been approved by Nutmeg & Bittersweet. In the case where
the item is forfeited or abandoned the winning bidder will not be compensated in any way
or receive any refunds and has released items back to the Family Estate.

• Shipping: Nutmeg & Bittersweet does not have in-house shipping or packing services.
WE ARE UNABLE TO GIVE REFUNDS DUE TO SHIPPING ISSUES.

UPS pack and ship service is best for medium to small purchases. Larger items are also handled with more costs involved as the
cost is determined by size, weight, and distance. Generally, the UPS store offers a pack and ship guarantee on your items;
however, this should be discussed at the time of your call. They also do International shipping. Our preferred UPS store will
also pick up and pack items on site and take back to their shop to process, please contact Hannah for more details.

Nutmeg & Bittersweet is not responsible for accidents, thefts, errors or omissions. We
reserve the right to refuse service to anyone bidding or selling. Purchaser does herby
indemnify and hold harmless Nutmeg & Bittersweet and Seller from any and all damages, claims or
liabilities from injuries to persons or property of any type whatsoever caused during the
sale or by the removal of items purchased. Purchaser assumes all risk and liability resulting
from the use of the item(s) sold hereunder; and shall defend, indemnify, and hold harmless
Nutmeg & Bittersweet and Seller from any liability.
Choice of Law: These Terms and Conditions will be governed by and construed in
accordance with the laws of the State of Kansas, without giving effect to its conflict of laws
provisions or bidder’s actual state or country of residence. Any claims, legal proceeding or
litigation arising in connection with the service will be brought solely in Johnson County,
Kansas, and all bidders consents to the jurisdiction of such court. The invalidity or
unenforceability of any provisions herein shall not affect the validity or enforceability of
any other provision, which shall remain in full force and effect. Circle has the full
discretion to waive or modify any and all of the terms and conditions contained herein.
